Mischief of Leasehold rights-Apartment ownership Laws

The following Suggestions were given to U.P. Government for safeguarding the interests of Flat/Apartment/Plot/Properties Purchasers and for removing the mischief of leasehold nature of properties but the same were thrown in the waste paper basket because the Bureaucrats simply wanted to please the Builders and make the Act for their benefit rather than for Public benefit. But seeing that some of the suggestions like f.a.r. and density increase, suited them, they were selectively adopted while all other were ignored. Please read the article carefully and send your comments

Short-comings in the Uttar Pradesh Apartment(Promotion of Construction, Ownership and Maintenance) Bill & some Suggestions.

I propose the following suggestions:-
Amendment in the Objects & Reasons
An Act to provide for matters relating to the ownership, individual rights as well as undivided interests in common areas & facilities & obligations of Purchasers of Apartments & Plots in Buildings & Townships & the common areas of these Buildings or Townships mainly developed by private Developers /Promoters / Builders & the Act may be extended to the Buildings & Townships developed & sold by Government Instrumentalities either wholly or jointly with private Developers.
An Act for promotion of Apartment Culture in the State so that Scarce Agricultural Land is conserved by means of common sharing of open areas, Lawns, common facilities & in general vertical growth of the Cities rather than Horizontal & for encouragement of the private Sector in the development of Residential, Commercial or Industrial accommodation and the development of Planned Townships having all the required Infrastructure to support the Inhabitants.
An Act to provide for Economical accommodation to the Citizens & specially to the needy weaker Sections of Society for accommodation of whom some density restrictions are also being relaxed by this Act.
An Act to provide for matters to minimize the disputes and litigations between the Owners of Apartments/Plots as well as between the Owners & Promoters.
An Act to provide for accommodation to the menial classes whose services are availed by the Apartment Owners & citizens of the City/Township & who are forced to live in slums due to lack of suitable accommodation near their work places.
An Act to provide for more spacious accommodation to the Citizens by way of additional f.a.r. subject to the number of dwelling units remaining unchanged.
An Act to promote creation of more open spaces, Parks & playgrounds by permitting more f. a. r. for lesser ground coverage.
An Act to provide for Use of Green Plantation Areas & Forests in the Townships for the purpose of providing parking space as well as for selling of goods by the poor vendors with preference to the owners or the family members of the Landowners whose lands are acquired for the Town Ships.
An Act to provide for sufficient Commercial space in Residential Townships so that the menace of Commercial activities encroaching upon Residential areas is curtailed and at the same time the Promoter is able to get better price to offset the losses that he may have to suffer on account of sale at lesser price to the deprived sections of the Society it will also allow him to offer residential accommodation at lower prices.
An Act to remove the mischief of complicated land owner ship rights and declare as symbolic all right of lessors in land leased by them and the leases having 75 or more years to expire.
An Act to provide perpetuity of owner ship and security of accommodation to Apartment owners.

Amendment & suggestion for definitions
In clause-(w), Promoter will include the owner or Lessee of the Land on whose land the Promoter or builder by whatever name called enters in to a Builders agreement to build or develop a building or plots & to sell them. In such an event the Owner or Lessee shall be deemed to be Co-Promoter for the purpose of this Act & shall be jointly responsible for all the obligations of the Promoter under the Act & shall jointly sign all the plans & Declaration.
After clause-(x), following clauses shall be inserted. (x-1)- “f” means the floor area of the individual Apartment in a building or plot area of a Plot in a Township as the case may be. (x-2)-“F” means the total permissible floor area available to the promoter under the Town Planning Laws applicable to the building or Township or as available under this Act, at the time of sanctioning of the development/building Plans by the Sanctioning Authority for the same. (x-3)- “f. a. r” means, in the case of buildings, the floor area ratio i.e. total permissible floor area (as per the Town Planning Laws in force or under this Act), of the Building/s divided by the total area of Plot deemed to be connected to the Building/s .In the case of Townships it means the total permissible floor area (as per the Town Planning Laws in force or under this Act), of the Township or Sector or Block by whatever name called divided by the area of the Township or Sector or Block.


Amendment in Section-4(1)
1. Instead of the existing phrase the following shall be substituted. 4-(1)-Any promoter who intends to sell - (a)-An Apartment in a building/s having a individual Plot deemed to be attached with the Building/s.
or
(b)- A Plot of Land in a Township or Sector or Block or Pocket of a Township
or
(c)-a constructed building having less than four apartments (on a separate plot) in the Town Ship or Sector or Block or Pocket of the Township.

Shall firstly, in addition to other documents which may be needed by the Local Authority having the power to sanction the development/building plans, make the following declaration before the Competent Authority as well as before the Local Authority as above and this Declaration made as hereinabove Shall be disclosed to the intending purchaser & shall form a part of the agreement between him & the Promoter whether he asks for it or not. This declaration shall Disclose amongst others the following—

(i)- The total area of the Land deemed to be attached to the Building/s.

(ii)- The floor area for construction purpose available on the Land as per the provisions of the Town Planning Laws or as available under this Act, at the time of applying for sanction of the building/development Plan.

(iii)-The total number of Apartments to be constructed with details of the floor area of each apartment separately.

(iv)-Not withstanding any thing to the contrary in Section-5-(2) or any other part in this Act, each person, who becomes entitled to the exclusive ownership and possession of an apartment shall be entitled to an undivided interest in the Plot of Land deemed to be attached to the Building/s including the common areas and facilities = f /F -where “f”=the floor area of the concerned Apartment & “F”=the total permissible floor area available (as per the Town Planning Laws in force or as available under this Act). Explanation- If any Apartment / area is provided (till the time he continues to provide the said service), free of cost or on rent or license to anybody for providing some essential utility like water or electricity or Fire or Police service or postal services & any other service necessary for needs of the Apartment owners, then, other than, the use of the allotted Apartment or Space, such service provider, shall not be entitled to any undivided interest in the property & shall be merely entitled to the Use & occupation of the area allotted to him & to those common areas & facilities of the property as are essentially connected to the provision of the said service. Explanation-2- Purchase of any parking Space shall not in any way add to the Undivided Interest of the purchaser in the property it shall merely entitle him to the Use of the Parking Space.( More attention needs to be paid to this issue as it is a sensitive issue requiring more specific provisions)

(v)- It is further clarified that if there is any increase or decrease in the permissible floor area for construction, applicable on the property, between the time of applying for sanction & the actual sanction then the Promoter shall ensure compliance with the amended provision as applicable on the date of sanction & obtain the sanction. The finally permissible Total Floor Area i.e. “F” shall prevail for the purpose of Declaration as provided in Section-4-(1) & shall be taken in to consideration for any sale to Intending Purchasers.

(vi)- If after the sanction of the Building/Development Plans, any additional permissible Total Floor area or f. a. r. becomes available on the property then the Apartment purchasers, who have become entitled to an apartment by making any payment(and obtaining receipt) either as an advance or as a token payment by whatever name called shall not loose any part of the undivided interest in the property & the common areas & facilities as has been deemed to have been created in their favor on the date of the initial payment, by the formula “f / F ” taking as a basis the Declaration referred to in Section-4-(1). In such an event the Promoter shall be entitled to the benefit of the increased f. a. r. only on the remaining unsold Apartments & he shall before selling any other Apartment, make a modified Declaration under Section-4-(1), containing the necessary changes & the leftover undivided interest in the property shall be divided amongst the new purchasers as per the changed Declaration.

(vii)- On becoming entitled to any additional f. a. r. after the sanction of the original building plans, the Promoter shall serve a notice by registered post to the Competent Authority as well as the Local Authority empowered to sanction the Building Plans and to all the Apartment Allot tees till that date and the date of service or refusal of this registered notice shall form the basis of determining the interests of the parties. It is further clarified that the availability of any additional f. a. r, on the property shall not absolve the Promoter of the responsibility to comply with the original Construction Schedule as disclosed in the Original Declaration.

(viii)- In case the additional permissible f.a.r. becoming available after the sanction of original Plan exceeds the sanctioned f.a.r by more than 25 % then in addition to the provisions of safeguarding the undivided interest of the Apartment Allot tees provided as above, it shall be mandatory for the Promoter to obtain the No Objection of all the Allot tees as on the date of service of the notice.

(ix)- The Promoter shall not be entitled to the benefit of any additional f. a. r which becomes available on the property after the date of happening of the earliest of the following events (a)-Issue of Occupancy / Completion Certificate ;(b)-The date of Likely Completion of the Building as declared in the Declaration under Section-4-(1); (c)-The date of putting in to possession of any of the allot tees /purchasers of any Apartment. After this date if any additional f. a. r becomes available on the property then the Apartment owners/allot tees as on this date shall be entitled to the benefit of this additional f. a. r and the Promoter shall be entitled only to the benefit available on the unsold Apartments. When the Apartment Owners become entitled to this additional f.a.r then to utilize this benefit they shall have to take further steps only through the Association formed by them as per provisions of this Act and if the structural safety of the Building permits (certificate to this effect will have to be obtained from an Authority or agency or Panel of Structural engineers which may be nominated or approved by the Competent authority or Local authority or the State Government) additional construction then such additional construction may be undertaken by the Association & divided amongst themselves provided at least 80 % of the Apartment Owners give their N.O.C. in writing to the association. In case there is some other space available to the association under joint ownership of all the Apartment Owners in excess of the mandatory minimum Parking Area and other common Areas which are to be kept un-built upon as per provisions of the Town Planning Laws in force on date of fresh sanction then this space may be built upon provided there is ample space for Parking & Common areas to serve the new dwelling units to be Constructed. In all such cases all the apartment Owners together with the Association shall be deemed to be Co-Promoters for the purpose of this Act & shall be obliged to comply with all its provisions if they want to sell at any time, any part of the property or additional Apartments built on account of the additional f. a. r. available. Provided that for this Section and for any other Section of this Act, each Apartment owner shall be entitled to one vote of equal value irrespective of the area of his Apartment. It is only for the purpose of the valuation of the property in the case of sale or mortgage or insolvency or for Insurance & other like financial purposes that the interest of the Apartment Owners shall be considered in proportion to their undivided interest created in the property on the basis of the floor area of their Apartment.

(x)-If the promoter is unable to use up the original f. a. r available to him before the date of happening of the earliest of the following events (a)-Issue of Occupancy / Completion Certificate ;(b)-The date of Likely Completion of the Building as declared in the Declaration under Section-4-(1); (c)-The date of putting in to possession of any of the allot tees /purchasers of any Apartment, then he shall not be entitled to do so afterwards and in that event the undivided interest of each Apartment Owner will stand proportionately increased to f/Fa where Fa=the actual Floor Area out of the total permissible floor area used up till the above date.
Some of the above complications can be avoided if provisions are laid beforehand disallowing any increase in f.a.r after the commencement of the Building/Township.
Suggestions regarding Density Restrictions & f. a. r
A- It has been observed that day bye day the prices of properties are increasing on account of speculative tendencies & at the same time prime Agricultural Land is being lost to the expanding Cities and this is driving residential accommodation beyond the buying power of the masses. People are being forced to live in worst conditions than even Beasts in small hovels. Talking about Kanpur when Jawaharlal Nehru visited Kanpur, soon after independence, in the early Fifties, he used these very words when he visited a few hataas on G.T road in Kanpur. Since then ten five year plans have gone by & the nett result is that now there are fifty times more such Beast like creatures (poor citizens), living in smaller hovels. The situation is the same in all the cities of the Country.
One of the reasons which forces ordinary citizens to live in such small houses is the denial of proper f.a.r by the Town Planning Authorities for reasons best known to them. It is the dwelling Units permissible, which should be restricted & the restrictions of f.a.r should be lenient & related to the creation of more open spaces. By order dated December-12-2003 of two Judges,
J. Rajendra Babu & J. G.P. Mathur , reported in (2004) 9 SCC-569, held that no objection can be taken to allowing more F.A.R to give more spacious accommodation to the Citizens, provided the Number of permissible Dwelling Units is not increased
Keeping in view the Mumbai Town Planning Restrictions, which provide for a Dwelling Unit density of 450 dwelling units per hectares. However since the problem in U. P. is not that acute and lesser density can be fixed. I therefore make the following suggestions,

1. No group housing Activity (construction of more than Twenty Apartments with undivided interest in common areas) shall henceforth be permissible on a plot of less than 4000 square meters of Land.
2. Not withstanding any thing to the contrary in any other Law for the time being in force Each hectare of Land in any New Township henceforth to be sanctioned on more than (minimum area to be specified preferably not less than 100 hectares i.e. 1 Km X 1 Km) of land shall provide for at least 150 dwelling units per hectares. Any density restrictions of any Zone or area, in which the development of the New Town ship is sanctioned, after the coming into operation of this section /Act in any Master Plan of any Urban area /Municipality shall stand increased to 675 persons per Hectares for the area of the Township.
3. Not withstanding any thing to the contrary in any other Law for the time being in force including any Town Planning Act or Master Plan, the maximum number of dwelling units permissible per hectares shall be not more than 300 (each dwelling unit is deemed to be inhabited by 4.5 persons for the purpose of calculation of density).
4. (1)-Not withstanding any thing to the contrary in any other Law for the time being in force, at-least 20 % of residential dwelling units to be created in any new Township shall be allotted, complete in all respects to the economically weaker sections of Society [to be specified by the Government / Competent authority(subject to 30 % reservation of these dwelling units for the residents of the Village/s whose lands were or are acquired for these Townships whether by agreement or by an Award under the Acquisition Act In case of other allottees of this category, due regard shall be paid to the usefulness of the Allottee for the Township i.e Barber, Dhobi, sweeper, Domestic help & the like ) in such manner as may be prescribed, subject to the condition that it shall not be sold or transferred or let or kept vacant in any manner by the allottee for at least twenty five years from the date of possession )] at the following rate— (a)- In the case of built-up Apartments, at the cost price of the Construction of the Apartment so allotted (cost to be calculated by a qualified valuation expert out of a list of those nominated by the Government) only(The Competent authority may provide for further reduction of the sale price in the case of allotment to the Villagers of the Villages where these Townships are situated . (b)- In the case of the plotted Development at the purchase cost of the Land calculated by multiplying the sale consideration paid by the Promoter per square meter of land by the area of the plot so allotted subject to a minimum of 50 square meters. Explanation-1. It is hereby clarified that in calculating the cost of the apartment under this section, the cost of land and any other amenity or facility shall not be taken in to account.
Explanation-2. It is hereby clarified that the minimum Carpet area of each dwelling unit to be allotted to the weaker sections as above shall be = 40 square meters & shall comprise of at least two rooms + one kitchen +one Toilet cum Bathroom and one balcony.

Explanation-3. It is hereby clarified that while calculating the total number of Residential dwelling units for the purpose of this Section, all the residential dwelling units of the Township shall be taken in to account.
Explanation=-4. It is hereby clarified that such Allottee of the weaker Sections shall also gain an undivided interest in the property in proportion to the floor area allotted to them in the same manner as the other Apartment owners. This undivided share may be mortgaged to a financial Institution to avail loan by the allottee. 4-(2)-The Competent Authority or the Government may call for applications for such allotments after the construction of the Building or Plotted Development has commenced & upon such Commencement, the Competent Authority or the Government shall be deemed to be the allottee of the Apartments & shall be obliged to make necessary arrangements for immediate payment to the Promoter for the cost of these Apartments as agreed upon with the Promoter or in five equal installments depending on the progress of the building starting from one month after the Commencement & ending with the final payment within one month of being put in to possession or deemed possession which will be the date on which a period of one month has expired after the issue of Completion /Occupancy certificate.
5. Not withstanding any thing to the contrary in any other Law for the time being in force & subject to complying with the provisions of the previous section & subject to the maximum permissible number of dwelling units remaining unchanged, the maximum ground coverage & the f. a. r. available for group Housing & Townships shall be as under (a).The maximum permissible ground coverage --------------30 % (b).maximum permissible f.a.r. in case of 30% ground coverage=2.00 (c)-maximum permissible f a.r. in case of 25% ground coverage=2.25 (d)-maximum permissible f.a.r. in case of 20% ground coverage=2.50 (e)-maximum permissible f.a.r. in case of 15% ground coverage=3.00 (f)- maximum permissible f.a.r. in case of 10% ground coverage=3.50 The above recommendation of more f.a.r for lesser ground coverage is based on the principle laid down by Awas Anubhag –3 Notification No.1084/XXXVII-3-29-N.K.V.-86 dated May-18-1987 regarding Lucknow Master Plan. However in that the Commercial area specified was very low resulting in Chaos in the Cities, where the commercial activities have encroached on all other Users. Additional commercial User will allow the Promoters to give concession on Residential Dwelling Units.
6. In addition to the maximum permissible f. a. r. as above, a further additional f. a. r of 0.5 shall be available to a Promoter who in compliance of the mandatory requirement of allotment to economically weaker sections, instead of 20 %, allots 40 % of the residential dwelling units to the economically weaker sections of Society.
7. In the case of Commercial Sections, the Provisions of this Act shall apply mutatis mutandis and separate Rights& undivided interest in common Areas & facilities of these Commercial areas shall accrue to all the Apartment Owners (includes owners of Offices, Shops, Showrooms as the case may be). It is hereby clarified that apartment Owners of Commercial areas shall not obtain any undivided interest in the Common Areas & facilities of the Residential Section & vice versa.
8. In the case of Commercial areas the following Ground coverage & maximum f.a.r shall be permissible-
(a).The maximum permissible ground coverage --------------40 % (b).maximum permissible f.a.r. for above 25 % to 40% ground coverage=2.00 (c)- maximum permissible f.a.r. for above 15 % to 25% ground coverage=2.50 (d)-maximum permissible f.a.r. for up to 15% ground coverage=3.00
Other provisions which are essential & may be incorporated
9. The Promoter will be entitled to & bound by the Specified number of maximum & minimum number of dwelling units, ground coverage, f. a. r. etc on the basis of the entire area of the Township to be developed by him without excluding any area of roads, parks, open spaces etc. However the area set aside for Commercial centers shall be excluded from it. In addition to this 1 % of the total permissible dwelling units can be constructed additionally for Security & care taker staff but within the same f. a. r . These additional units shall not be sold & shall be at the disposal of the Association formed for the Building/Township/sector/pocket/Block as the case may be. The promoter shall be entitled to recover the cost of these by proportional addition to sale price of the Apartments.
10. Not withstanding anything to the contrary in this Act or any other law for the time being in force, the Promoter shall set aside for Commercial activities( like Shops, Showrooms, Nursing Home /Hospital, Offices, Guesthouse, Multiplex, Community Center & the like)of the Township, at least twenty percent & maximum twenty five percent of the Land Area of the Township, at specified locations (to be specified by him). Each of these Commercial Centers shall be specified as a separate sector or block or pocket by the Promoter. All such Commercial Centers shall be clearly demarcated by means of some visible permanent markers & shall be separated from the Residential Sectors /blocks /pockets, preferably by Roads + Parks, Plantation Areas, Playgrounds, Open Spaces . However, in the case of smaller Townships, where such separation is not possible, by a minimum distance to be specified & at least half of this separation area shall be planted with large trees on the Residential side of this separation area to insulate it from noise & pollution of the Commercial area. The other part of the Separation area towards the Commercial area may be used for Road, additional Parking. Endeavor should be made to have a clear separation of at least 100 meters between the Commercial Centers & the Residential Blocks.
11. Not withstanding any thing to the Contrary in any Law for the time being in force, including the Registration Act & the Stamp Act, where any Land is purchased by a Promoter (who intends to develop a Township under the provisions of this Act) after intimation to the Competent Authority/Local Authority/the State Government as the case may be and after obtaining the clearance for the same, stamp duty @ only one percent shall be payable by the Promoter for the registration of such Land subject to the condition that he shall make the necessary developments & execute the registration deeds of all the apartments & developed Plots before delivery of possession and in any case within five years & thereupon Stamp duty at a rate to be fixed by the Government (but not exceeding five percent of the sale consideration) shall become payable & till such time the Stamp & registration Department shall have first lien on the property, which shall be duly recorded in the Sub-registrar’s Office at the time of purchase by the Builder. Provided that the Circle rate taken in to consideration at the time of the purchase by the Promoter shall be deemed to be the Circle rate for Agricultural Land.
12. Not withstanding anything to the contrary in this Act or any other law for the time being in force, A Building,( in which Sale of Flats has been permitted by the Competent authority to the Promoter) shall be completed and the purchaser/Allottee unless disqualified under this Act shall be put in to possession immediately after the expiry of three years from the date of commencement of the building. In the event of any default by the Promoter, The State Government/Competent Authority shall be deemed to have been appointed as the receiver of the property & shall take the necessary steps to complete the building & safeguard the interests of the apartment Owners/Allottees as well as the interest of the Registration & stamp Department and any other Government Department & till such time all interest of the promoter shall stand suspended and after the above obligations have been met by the receiver, the interest of the Promoter shall revive only in any surplus left either in shape of money or un sold Apartments subject to further reduction on account of Administrative charges to be deducted by the Receiver.
13. Not withstanding anything to the contrary in this Act or any other law for the time being in force, where a Promoter intends to develop a Town Ship under the provisions of this Act, he shall submit a complete plan of the same including the stages by which he intends to proceed & complete the Township The Plans shall clearly show the Residential Areas of the Township & the Commercial Areas and these shall be demarcated in to Phases /sectors / pockets / blocks as the case may be.
14. The Plans shall further show the Parks, the Plantation areas, the Open Spaces & the roads & the Playgrounds & Schools, Colleges & other public utilities.
15. In Residential Section of the Township (i.e. total Township area minus the Commercial Area set aside, a minimum of 10 % land area shall be developed as Parks; a minimum of 10 % as Playgrounds; a minimum of 2 % as Open Spaces to cater to Dussehra / Durga-pooja & other religious & social & cultural Users requiring Open Space (no such celebration shall be permissible in Parks & Play grounds). Provided further that these open spaces may be utilized for temporary vegetable/fruit markets, handicrafts bazars & fairs to provide space to small vendors & Hawkers on temporary basis only.
16. Adequate provision subject to a maximum limit of one percent of land shall be made to accommodate Temples / Gurudwara / Church / Mosque & this will be left to the discretion of the Associations.
17. Provision for suitable number of Nursery & primary Schools based on the Education Department’s Norms shall be made in the Township.
18. Plantation of lar­ge Trees with a distance of thirty to fifty feet between the Trees shall be done on at least 10 % of the entire Land of the Township including the Commercial Areas. Each Tree shall be provided with an enclosure of six feet on all four sides by means of a fence or Tree Guard. However beyond these enclosures, these Plantation Areas may also be used for, Jogger tracks; for providing space for Additional Parking Areas; Space shall also be allotted (as per norms to be prescribed by the Competent Authority/State Government /Local Authority as the case may be, in these Plantation Areas & the other parts of the Townships, for Vendors & Hawkers & Kiosks may be constructed for the purpose & allotted provided that fifty percent of all Hawking/Vending Spaces/Kiosks in any Town ship (including the Plantation Areas shall be reserved for allotment to the Inhabitants of the Villages on whose lands these Town ships are situated & amongst these fifty percent, half shall be reserved for allotment to the family members of those Villagers of these Villages who were considered as Landless villagers within the meaning of the U.P. Zamindari abolition & Land Reforms Act-1950 at the time of the Acquisition of the Land of the subject village. Provided that the Vendors & Hawkers will only be permitted to enter in to & sell their wares during the time (for a minimum duration of ten hours daily) to be prescribed by the Association. Provided that at least 50 % of the land of the Plantation Areas shall be left open as raw earth i.e without any artificial paving & the balance area may be covered with tracks/flooring by means of porous material or Tiles. Provided further that no permanent structure of any masonry material shall be constructed in these Plantation Areas other than water tank/ tube well etc.
19. The Builder shall complete the Development of the Township within the time specified in the Declaration & in any case within seven years. Prior to this period for completion of the Township, he may complete the various Phases of the Township/ Sectors / Pockets & Blocks one by one but in that case he shall have to provide the minimum common facilities like Parks, Tot-lots, Jogging tracks etc & proportionate number of Schools out of the total planned as well as sufficient number of Shops /Commercial space so that the daily needs of the Inhabitants are met.
20. The Township shall be directly accessible from a public road of at least 30 meters width across the entire length of at least two sides of the Township & in case of any shortfall on this account the Promoter shall have to provide space from the Township’s Land so that the shortfall is met & in such an event, the Road Land so contributed shall be owned by the Township but for all practical purposes shall vest in the Local Authority for the purpose of a Road, qua a Road and the local Authority shall have no other right of any commercial exploitation of this portion of the road other than normal laying of Sewer lines /water/electric lines and other public utility lines.
21. (1)-In order to allow for smooth traffic on the Public Roads, with minimum of merging traffic, the Township shall be completely enclosed by a Compound wall of such height as may be permitted by the sanctioning Authority subject to minimum of two meters. Access to the Public Road may be had from common Entrances /Exit openings of not more than 30 meters width in the Compound wall provided that the minimum distance between any two openings on any one side shall be five hundred meters measured from center to center of the opening. It is hereby clarified that this distance restriction shall not apply in case of Openings on different roads i.e An opening in the North wall may be situated right next to the Opening in the Eastern or Western Wall i.e. on the Corner & so on. No such opening shall be made within ten meters of any Commercial Building of any Commercial area.
(2)- Parallel to the Outside Public Roads, There shall be Constructed inside and alongside the entire length of the compound wall, a inner road of the prescribed width as per the hierarchy of roads prescribed by the sanctioning Authority for Development Plans, shall be constructed so that the entire traffic of the Town Ship enters & exits only through prescribed gates of the Township.
(3)- Alongside all the Openings in the Wall, there shall be constructed a depression or alcove in the Compound wall & it shall be covered in a suitable manner so that a space of twenty meters wide by five meters deep is available, outside the Compound wall as a Bus Stand/shelter + public Toilet to the general public. The ownership of this Bus stand/shelter shall vest in the Township but free use shall be permitted to the general public. (4)- The Compound wall shall at all times be maintained in proper state without any breach or any reduction in height at any point & if at any time it is found to be broken allowing access to the Public Road at places other than the designated Openings then the Association shall be held liable & a fine of Rupees Five thousand per day shall be levied & shall become payable to the local Authority in whom the Public Road Vests. The Public Authority shall be entitled to get the repairs made at the cost of the Association.
(5)- No Residential or Commercial building other than that provided to the Security staff or for Public Utility Service providers shall be situated within a distance of ten meters from the Compound Wall
22. It shall be obligatory upon the Promoter to provide suitable Space as per the stipulated Norms of the Zonal Plan on the periphery of the Township free of cost to the following service providers & public utility services. (1)-Police Post/Station. (2)-Post Office. (3)-Fire Station. (4)- Electric Substation. (5)- Water supply department (if public water supply is availed of. (6)-government dispensary.
(7)-Any and all other utility providers which may be prescribed by the Sanctioning authority to be allotted space either free of cost or in case of profit making service providers like the Telephone Department & the like after realizing payment. Provided that where the Size of any Township is small and it is impracticable to burden it with all these then the Sanctioning authority shall ensure that the required number of Townships are clubbed together & proportionately levied with the burden of providing these services. It shall be the responsibility of the Sanctioning Authority of Development plan to provide all these public utility services to all the Inhabitants of the Town Ship/Zone.
23. Land and building for Sufficient number of Primary schools & Land only (for required Number as per planning norms) for High Schools/ Inter colleges and Degree Colleges shall be provided by the Promoter as per the Norms of the Education Department all of which shall be handed over free of cost, for running & management only to the Local Authority having obligatory functions to provide Primary Education. Thereafter it shall be duty of the Authority to either run them itself or to give them to others on lease of fifty years/ renewable for further periods subject to compliance of terms and conditions (with first preference to Cooperative Societies of Teachers), without any charge, other than local Municipal taxes, the underlined idea being to provide cheap education to the masses. The builder will be entitled to add the cost to the Apartments/plots/properties sold by him.
24. The Possession of Commercial accommodation shall be given simultaneously or within two months before or after the Possession of Residential apartments & in proportion to the Residential Apartments the possession of which has been given. Explanation-1- If the promoter is in a position to give Possession of ten percent of the dwelling units then he shall be permitted to give possession of up to ten percent of the Commercial Area, two months before or within two months afterwards and so on. This restriction shall not apply in case of Commercial Plots sold for Nursing Homes /Schools & public utility services.
25. Suitable Parking Space shall be provided within the Township for Parking purposes of the Inhabitants as well as the Visitors. No parking of any Vehicle shall be allowed outside the Compound wall of the Township/Apartment Building as the case may be. A fine of Rupees two hundred shall be recovered, on the Spot, by the Local Municipal Authority from such Vehicles found parked out side and the same will be impounded in case no occupant is found therein on the spot.
26. The Competent Authority or the State Government shall lay down the norms for forming the association of Apartment Owners & it may provide for forming of Associations, Building wise, specified number of Apartment wise-, Sector wise, Block wise, Pocket wise & then from amongst these for formation of Phase wise & Township wise Associations and assign to these, specific duties, rights& functions.
27. These suggestions have been drafted in haste so that they may be put up, in time before the concerned stake holders who are welcome to fine tune & adopt as many of them as they find suitable.
28. Provisions to stop speculation in Land.
(a) Not with standing anything to the contrary in any other law for the time being in force, vacant plots & apartments will attract penal property taxes at at least twice the rates as are applicable on occupied apartments.
Provisions to avoid legal battles on Account of unregistered eleven month tenancy agreements.
29. Apartments rented/leased out for less than ten years to be levied only with one percent stamp duty & maximum 5000/- as registration charges. Those rented/lease out for more than ten years to less than 30 years to be levied with maximum 2% stamp duty. Any new lease for more than thirty years or where old rent/lease agreement is extended beyond thirty years to be deemed to be transfer for the purpose of stamp duty & subjected to stamp duty at that rate subject to maximum of 5%.
Removal of the mischief of complicated lease hold rights (started by Foreigners, who had a long History of Land Lord Tenant relationships i.e. a feudal system of Land owning gentry) and for provision of security and permanence of owner ship rights to apartment owners.
30. Where a owner or lessor of any property joins as joint promoter or is deemed to be joint promoter then not with standing any thing to the contrary in any law for the time being in force he shall be deemed to have extended the lease for perpetuity i.e. free hold & shall jointly sign all the sale deeds of apartment owners & in case he himself is a lessee of some body else then it will be deemed that he has extended the lease for the remaining period of his lease & all his interest in the lease of the property shall come to an end automatically at the termination of the lease period & the apartment owners shall step into his shoes collectively.
31.(i) No Township or building under their Act shall be developed on any land under lease if the lease period remaining at the time of applying for sanction to the building or township is less than 75 years.
31 (ii) Not with standing anything to the contrary in any other law for the time being in force in case of lease hold lands, the lessee who joins as co-promoter and holds full rights in the lease for at least 75 more years as on date of applying for sanction of Development for a Township or apartment building shall be deemed to be the final lessee or deemed owner of the land and all previous lessors /leasees or sub-lessor /sub-leasees by what ever name called shall be deemed to be jointly holding equal but only symbolic rights and interest in the land and such total symbolic interest will be valued at 10% of the market value based on the prevailing circle rate of the land on the date on which the final lessee/ deemed owner applies for sanction under this Act. All these previous lessors /leasees or sub-lessor /sub-leasees by what ever name called shall be called "PARAMOUNT LESSORS".
32. (i) Before according sanction to any new township or building under this Act the competent Authority shall at the cost of the promoter, cause public notice to be sent by registered post twice within a period of two months at the address if known or recorded in the lease documents of the PARAMOUNT LESSORS. The said public notice shall also be published in at least two news papers (one in English and one in local language) having maximum circulation in the area know or believed to be the area where out of the "PARAMOUNT LESSORS", the lessor who lastly executed the existing lease, or his heirs reside. The said public notice shall also be published in two news papers as above in the area where the property is situated.
32-(2) After the sending by registered post and publication of the public notice as above, if within one month no objection is received then not with standing anything to the contrary in any other law for the time being in force the "PARAMOUNT LESSORS" shall be deemed to have Consented to make free hold the lease in favor in final leasee/ deemed owner & the Competent Authority shall be obliged to issue the necessary certificate to this effect which shall be registered by the sub registrar after receiving the necessary Registration fee not exceeding ten thousand rupees and 2% as stamp duty from the promote or joint promoter as the case may be provided the promoter or joint promoter have deposited the compensation to be paid to the PARAMOUNT LESSORS.
32-(3) If in response to any public notice as above any paramount lessor or his heir submits an objection in writing then the residual interest of all paramount lessors or their heirs, not with standing any thing to the contrary in any other Law for the time being in force shall be deemed to be fixed at ten percent of the market value of the land based on the circle rate as prevailing on the date of application by the final lessee/deemed owner of the land for sanction for development of the building/apartment and this compensation shall be deposited with the land acquisition Tribunal under the Land Acquisition Act-1894 from where the claimants may claim it & for this purpose no court fee shall be payable by the claimants and the same procedure as under the land Acquisition Act shall apply for payment of this compensation amount. Explanation:- It is hereby classified that not withstanding any thing to the contrary in any law for the time being in force the amount of compensation as determined above shall in no case be in creased or decreased by any Court, Tribunal or other Authority.
32 (4) The Certificate of ownership issued in favor of the final lessee/deemed owner as mentioned above shall have effect only after the occupancy certificate/completion certificate has been issued by the plan sanction Authority for the Building/Township plan i.e. at the time of sale deeds by the promoters in favor of Apartment owner.
32 (5) In case no claimant comes forward within one year of the last publication of the public notice (informing the Paramount Lessors), to claim any interest as PARAMOUNT LESSORS then the compensation amount deposited by the promoter to acquire symbolic interest of the PARAMOUNT LESSORS shall belong to the competent Authority who will use it for the proper implementation of the Act.

As written by a British Hospital Patient describing how the British Taxpayers/ Original Inhabitants are forced to lift the burden of good for nothing immigrants, while the natives face unemployment and resources crunch. The same thing is happening in India, viz a viz the Bangladeshi Immigrants, Maharashtrians complain about too many North Indian Immigrants, who are pushing the natives in to accepting a much lower standard of living then what they enjoyed before being overwhelmed by cheap immigrant-labour.
If this genuine problem is not solved by some reasonable restrictions, then the Country is bound to break up in to many many pieces. Even America is waking up to the plight of the natives. It would be better if Indians living in Countries facing Resources Crunch, openly and in a substantial manner, contribute to their adopted Countries National needs and stop waving the National Flags of their rejected Countries.
I feel much ashamed, when I see Ex- Indians, Citizens of England, U.S or Australia, waving the flags of India, even in Sporting Events in which their Adopted Country is the opponent. It is one thing to wave the flag of India in England in a Match between say Australia and India but quite another thing to do so in a Match between England and India, in England. That is why and rightly so, We are shunned by the White Man, on whose charity we survive.

1. Once again the Bofors Controversy is in the headlines,
with the clean chit of CBI to Quatrocchi. I feel that it is high time that we forgave Rajiv Gandhi, who although guilty in the matter was only a victim of a Conspiracy of the Scheming Old guard of the Congress party at that time, comprising of V.P. Singh, one fat politician with “Nehru” in his name and some others.
2. When Rajiv was forced in to P M ship due to the
untimely demise of Indiraji, this scheming old guard was taken aback due to the huge popular mandate Rajiv got in the elections. They were jealous of a modern, Lotto Shoe wearing, Ray ban Goggles supporting handsome almost God like man, with modern outlook and thoughts & dreams full of a secure and happy future for his Countrymen. As against this the Old guard still had the feudalistic approach, haggard and ugly appearances and they prevailed upon him saying “let us not depend upon local business men or corruption for funding of the party, but since money is a necessary evil for funding the party, let us instead take some lump sum money in multi billion dollars Defense deals, without compromising with quality, so that we are not dependant on local businessmen & widespread corruption.”
3. Once he, unwittingly and foolishly agreed, this very
same Old Guard blew the whistle and trapped him for ever. Although he was able to escape the continuing humiliation due to his un-timely death in 1991 & V.P. Singh officially once declared as Mad by his wife, became the P.M and he along with Chandrashekhar(a known Mafia) & others was responsible for Rajiv’s death. People say that Rajiv’s close Doon school chum Arun Singh, the then Minister of State, became a recluse in his Castle in the hills, may be he could have cleared the mist.
4. All that is good in India, presently, like Telecom
Sector, Computer and IT boom, Space Research, India becoming a Economic powerhouse, Educational Hub etc is all due to the modern outlook of Rajiv Gandhi. Had Rajiv not happened to India and had we been left to the haggard Old Guard like Atal, Advani, V.P. Singh, Chandrashekhar and others, we would have been left to languish in the middle ages, like Pakistan & may be even Talibanized.
5. Therefore it is time to forgive Rajiv Gandhi for the
Faux pas he made and pay tribute to him, bury Quatrocchi bury the Bofors Scam and move on. Remember in Kargil war it was the same Bofors Gun, Which was instrumental in uprooting the Pakis from the hills they occupied, quality was not compromised and see the present, where bribes are taken in thousands of crores and for that such innocent looking sectors like Land-Use control & conversion, Spectrum allotment, Anti Dumping duties(levied when local business houses form a syndicate and grease the politicians palms) etc. Had Rajiv been alive, these evils would have not been there.

1. The History of Arse licking (sycophancy beyond limits),in
India dates backs to prehistoric times but here, for obvious reasons we start with Alexander’s time when several Indian Princes supported him against the Local King Porus. When the Islamic Invaders invaded India, they too had the support of millions of Arse Lickers, to help them in their Conquests, without this support they could not have succeeded. We Indians are the best Arse lickers of the World, which fact is demonstrated by the coming in to power of so many Criminal Politicians(Bahubalis).

2. Actually it is the failure of the Executive more particularly the Indian Administrative Services (I.A.S.) that has pushed the Indian Public in to the Lap of the Criminal Politicians because all genuine petitions of the teeming masses given to these Officers have fallen on deaf ears and the belief took root that to get any work done, one needed to patronize these Criminal elements as they were the only ones, whom the I.A.S feared. So cunning are these Officers that till today, they have not made a single Law, which puts any obligation on them to address the grievance of the public. They are free to throw any or all the petitions received in to the waste paper basket, save those in which either some politician or a I.A.S colleague or money is involved. You will find that out of thousands of petitions they receive daily, most, 99% are simply marked to the junior officers without any comments but in case of those in which they are interested, they will write “full report by tomorrow” or “discuss immediately” or any such other code language which they use, and which their juniors fully understand. Even the RTI Act, can only make you aware of what has happened on one’s petition but it too castes no obligation on the I.A.S to do any thing on it.
3-The things were not so bad till a few decades back, I remember that around thirty years back i.e. till about the early seventies, Politicians, regularly used to solicit donations from the general public including small traders even but no longer now because they along with the I.A.S have created such a Un-holy Nexus that most of the Country’s wealth is now concentrated in the hands of this combine and they no longer need financial support from the petty traders and general public. The I.A.S, the most cunning of all Castes of India, were quick to realize that, just like the Judiciary of India, their goal too in life i.e. that of money, glamour & Sex could only be realized by Arse Licking of Government(Politicians) and thus was born the Unholy Nexus. That, now, it is only large Business Houses & Corporates who rule the roost, they propose their ventures to the Politicians, who throw a few bones to the I.A.S and mange to get the work done leading to ghotala after ghotala as is evident from the recent hue and cry about billions of dollars of wealth of Indians, stashed away in Swiss Banks and other Havens, famous for stashing of Illegal money. Just recollect, how before increasing their stake in India, the Corporate World, including International Multinationals, spent billions of dollars in bribing the powers that be and waited patiently till the negotiable Instrument Act provided for Criminal action in case of dishonored cheques, making it easy for them to realize their dues, by taking advance cheques, before they went on a lending spree in India, which incidentally encouraged speculation in Land & Commodities and took these beyond the common man’s means and are responsible for the present recession also. As against this the general public, if they have to collect their dues, have to spend decades in Civil Courts and spend a hefty amount in Court fee.
4-Things were not so bad till about 1965, when the Old guard of the Civil Services, trained & who started their career under the British, were not part of the ruling mafia and there was some sanity and at-least some regard for the Laws but once the Politicians (who only had the limited power to transfer them) were able to convert the I.A.S in to their Arse Lickers, even the Laws are made only to serve the vested interests of this Politician-Bureaucrat-Corporate Mafia. You will find that thousands of children of High Court Judges, Politicians and I.A.S officers are getting fat pay packets from these Multinational Corporations, either as their Employees or as their franchisees /consultants /Lawyers. Which in turn also ensures that by 2030, India will be the biggest Brothel and Human Organ Market of the World. 5. If you need any proof about the Arse licking habits of Bureaucrats (I.A.S.) just recollect how roads, bridges, Fly-overs, Railway lines, Schools, Colleges, Polytechnics, Hospitals and such other public amenities are not thrown open to the public even weeks after their completion simply because the Bureaucrat waits for the Politician to give him a Arse licking chance by Inaugurating the facility. Can you think of any Civilized Country’s Bureaucrats (or politicians) stooping so low.I recollect that when Atul Gupta, the present Chief secretary of U. P was the housing secretary and Lalji Tondon was the Minister and Mayawatiji the C.M, he Atul Gupta got around 100 (one hundred), bare Inauguration stones of non existent projects, affixed on a brick wall in Kanpur and got them inaugurated. So strong is the Arse licking urge of the I.A.S.99% of I.A.S Officers fall in this category.My apologies to the honest 1 %.

Sir you claim to be and indeed you are the protector of Hindus worldwide. However you have made no efforts to secure the community from future threats on a permanent basis. All our Gods or you may call them, Avtars or Dieties or our ancestors, if, you wish, were all suitably armed, be it Vishnu or Ram or Krishna or Shiv or Hanuman, Ganesh, Kartikeya, Indra or for that matter Goddess Durga, Goddess Kali , who had Weapons in all their hands and yet because of influence of some passive sects like Jainism and Buddhism we have forgotten the lesson taught to us by our Gods i.e. that violence is real and peace is only imaginary even the Western thought says that the world started with a big bang i.e. with a very violent happening. Our own religion Sanatan Dharm also says that in the beginning there was only Shabd(sound it may be that here also reference is to the big bang). The great Sikh Gurus recognized this weakness of the Hindus and tried to tell them, that to save Dharma they need to be suitably armed and needed to initiate other protective measures, however although they failed to convince the cowards among the community yet they were able to convince a very large number about the need for an armed struggle and were instrumental in checking the tyrannical muslim rulers and saving the Sanatan Dharm. It is a pity that because of wide spread corruption in Free India and due to the political ambitions of the rich landed classes among the Sikhs, now the Sikhs think that they are separate from Hindus. Even they have forgotten the lessons given by the Great Gurus and even now are content to be armed with Kripan and at the most with a sword, weapons which in those days were the conventional weapons. Even at that time the Great Sikh Gurus used the modern weapons like the Guns and Cannon. In the present context, kripan and sword may still have some ornamental value and may be enough to scare away the Unarmed Citizens but it should be remembered that the Enemy is and will be very well armed and by the time the sword is drawn or the Kripan taken out, hundreds of bullets will have hit the Khalsa.. It must be remembered that the Gurus never meant these symbols to be mere ornaments but they were prescribed for protection of the self as well as the Faith. Therefore it is the need of the hour that the Akal Takth and other Sikh religious bodies issue a diktat that the Sikh will in addition to his conventional weapons, also and always carry a modern Firearm also. Let there be a confrontation with the Government over this if it resists.
Similarly You are requested to prevail upon the Shankracharyas to issue a similar edict. What are the Shankaracharyas and thousands of other Baba-logs, the Mahants, the Sadhus, the likes of Murari Bapu, Pilot Baba, The Gurumais etc doing any way? Just enjoying their billions in their fortified Ashrams. They are preparing Armies of Mosquitos by collecting millions of Bhakts and reading holy books((Historical texts) and citing from them and in the name of Ram and Peace taking the Bhakt’s money and fooling him by talking of peace while the fact is that the history as well as the future of the World was and will be full of bloodshed and gore. It will be interesting to know if the Government of India, Ministry of Home Affairs, keeps any data about the number of suicide Bombers (Fidayeen), who belong/ed to the family of the Taliban or Terrorist leaders of Pakistan and Afghanistan. If these Terrorist leaders are sparing their close relatives then it can be a propaganda tool to counter the Jehadis.and the people of Pakistan and other Islamic nations should be made aware of this fact, may be it will help the war on terror. How many Wives, Brothers, Sisters, Sons & Daughters of their own did Osama Bin Laden or Mullah Umar or Maulana Asad Mazoor or Betullah Masood send as fidayeen to die for Jehad. Is it only the poor & wretched and brainwashed Islamists who are sent by these Terrorist/Taliban leaders to blow themselves up & Die. Does the Government of United States keep any such record. May be we can seek this information from the Government of India under the Right to Information Act.

Dear Friends: It is high time we sought the answer to some basic questions, relating to the teeming masses , from the people in power in India. I intend to start a Nyaya Yatra, creating awareness amongst the people. The Nyaya Yatra will consist of visits to various Places in India, token hunger strikes there and eventually Fast unto death. If you agree then let me know. The following are the reasons & demands:-

Ten percent of the Indians, comprising of the Government Officials, the Politicians, The Judges, The Bureaucrats and the Super rich are exploiting and devouring the dreams and aspirations of the balance 90 %, i.e. the general public. Let it be, may be it is destiny and they are not to blame but the following minimum demands need to be met, While the Government is free to decide the Complicated issues like Nuclear option, the foreign policy etc but answers to some very simple questions relating to the citizens and the socialist character of the Nation, need to be given:-

Problem -1. Crores of cases are pending in Courts, the entire Judicial system is in shambles & has failed .The Supreme Court and High Court judges often proclaim openly that the Government is not providing the Infrastructure but none of them have ever done anything to force the Government, to act. On the other hand, if two Rail accidents take place, there is demand for Railways Ministers Resignation. The Home Minister Resigns after a few Terrorist attacks and the entire Government is called upon to accept Moral Responsibility & Resign In Maharashtra and other parts of the Country, thousands of Farmers have committed suicide on their failure to manage their families. Then why can not the Judges of the Supreme Court and High Courts also own up Moral Responsibility & Resign to put pressure on the Government.
Demand -1. I seek the Resignation of the Chief Justice and other Judges of the Supreme Court & High Courts of India so that the Government is forced to provide the Infrastructure for disposal of at least 95 % of cases within six months. At least ten times the present strength of Judges is required. Instead of prescription of minimum number of Judges in Supreme Court, Our Constitution provides for the opposite, i.e. there is restriction of maximum number. I had sent letter to Chief Justice of India on 07-11-2007, calling for his Resignation, the letter is reproduced here:-

Problem-2.The Government has monopolized & usurped the medical facilities of the Country for the chosen few while the general public is dying on the roads, due to lack of even the most basic of medical facilities Now how can the socialistic Constitution of India permit this. Billions of Rupees of public funds are spent on costly treatment of VIP’s.
Demand -2. The Central Government & State Governments should make available from public funds, for medical treatment of the common citizen, the same amount as they would spend for the treatment of the Prime Minister, the President, The Chief Ministers & VIP’s in States, the Judges , the I.A.S officers, Other State & Central Government Employees. In short free medical aid should be made available to the Citizens irrespective of his or her status in life or in the alternative; VIP’s & Government Officials should also die on the roads , same as the general public.

Problem- 3. Speculation in land has become the national Sport of India & Indians, every body including Governments, politicians, Traders, Government officers, Judges & other rich & powerful persons are engaged in buying, hoarding & selling at profit, land all over the country, just like potatoes and Onions. In case of housing land in urban areas, the State itself is the biggest Land mafia. At the same time, Crores of citizens are living like animals on roads on footpaths on drains.

Demand-3. Stop Speculation in Land. The Ceiling Act, repealed in 1999 has to be reenacted. & this ceiling should apply to all towns above 100000 population.Hang those who defy the ceiling. Ban Sale of Agricultural land in the Urban areas to non agriculturists (those whose families did not hold agricultural lands at the time of Agrarian Reform Acts within 15 km radius of the then Urban boundary).Exempt developers ,with the restriction that they will have to complete their Schemes within 5 years,
Ensure for provision of minimum 50 square meter of Housing land to all slum dwellers at rates affordable to them based on the average earnings of Indians after excluding the earnings of the higher earning ten % .

Problem-4.The Government has been spending billions & billions of rupees from public funds on the Security facilities of the VIP’s, while the general public is dying on the roads; in their houses, at the hands of criminals & terrorists. All our Hindu Gods & Goddesses carry a variety of weapons, Shiv ji carries a Trishul, Hanuman ji a Gada, Ramji -A Bow, Krishna ji & Vishnu-the Sudarshan Chakra, Ganeshji & Lord Kartikeya are suitably armed, Ma-Durgaji, Ma Kali are carrying weapons in many of their arms thus the message of my religion for me & all my fellow Country men of my faith is loud & clear-Violence is a way of life for your own Protection, Be suitably Armed for any eventuality. Two Terrorists killed hundreds of innocent citizens in Taj Hotel. Had the public inside been suitable armed and prepared, then could they kill so many. The Terrorists themselves would have died at the Citizens hands much before the NSG Commando’s arrived.
Demand-4. All the adult Citizens of India should be issued, on their demand, Arms Licenses for their protection & hand-Guns should be imported from China & given free of cost to them so that they too can have some chance to protect their lives, their loved ones and their property, from criminals and terrorists.

Problem-5. Millions of Job-seekers & students are cheated by Governments by not actually sending entrance papers and interview letters but they are shown to have been sent by way of false Under postal certificate (UPC), Almost all U.P.C’s are bogus.
Demand-5. Immediately ban the UPC service of Post office and instead send all intimation letters by Registered post.

Problem -6. All the Basics of life in India namely Education, Health, Justice & Housing are under the control of the mafia out of these the last two are under control of the Government which itself is the biggest mafia in control of Justice & having monopoly over Housing Land. these basics of life are priced out of the reach of the masses. There is an all pervading sense of insecurity amongst the masses leading to corruption at all levels. Politicians and Government officers have only two things on their minds, Bribe & Sex, Government Offices and Secretariats have become Dens of Pimps and Touts. Even Military generals are accused of embezzlements in purchase of meat, eggs and rations, selling subsidized Liquor in the open market and mixing water in Fuel tankers, which is a pitiable situation.
Demand-6. Take steps to ensure that Mafia elements are ousted from these Basic services , laws are suitably amended in a people friendly manner and all the basics are available at affordable costs to all and the sense of insecurity amongst the masses is no longer there. Provide for capital punishment for corruption.

Problem -7. It is a well known fact that thousands of false complaints are lodged against innocent persons daily leading to their harassment. People have been languishing in Jails for murders of people, who are alive.90 % of Dowry & SC/St harassment cases, are false.The Cr P C & the IPC are without adequate safeguards in them to protect the citizens against false complaints.The history of criminal trial in India & the mind set of the Judges, brings out a very disturbing picture and that is that if a F I R is lodged, then PUNISHMENT & IMPRISONMENT IS MUST no matter howsoever, false, the Complaint may be. Because if the Police finds the complaint to be bogus & expunges the F I R or files Final report then their action is opposed by the Courts on hundreds of grounds, like by saying that police has taken bribe etc from the accused etc etc, or the investigation is not proper etc etc On the other hand if a charge sheet is filed by the Police, howsoever false it may be then no Court will interfere & will say that the Police has acted most honestly & a innocent person will be harassed through out his life. It is much easier for the Police to charge-sheet an innocent person rather then to acquit him and they are taking the easy way out. Even the Supreme Court, which frequently over-rules the Judgments passed by full benches of the Higher Courts, when it comes to quashing the false Charge-sheets filed by Police Sub inspectors on the basis of false complaints/witnesses, take the word of the Sub-inspector as the Gospel truth.
Demand-7.Amend the Law so that false Complainant is given the death penalty. The Complainants should also be subjected to Narco Analysis & Lie Detection tests. These tests should also be used to prove the innocence of falsely accused persons, just as they are used to prove the guilt of the guilty.

Problem -8. The Indian State & the Judiciary is no longer capable of making proper Laws & proper interpretation of the Indian Constitution, due to the rotten Legal education system and pro Government wrong Judicial decisions prevailing since decades.
Demand-8.Call for Legal Experts from abroad to give lessons on Article 13 of the Indian Constitution & other fundamental Rights of Citizens to the Indian Judiciary.

Problem -9.Actually the problem is that when the British made the laws in India all legislation in India was based on the principle that those implementing it will be absolutely fair & that is why most of the legislations are failing presently because the implementing agencies are totally dishonest hence if any legislation in India is to succeed then, it should be kept in mind, while framing it, that the implementing agency is most likely to be totally corrupt & therefore for this purpose necessary safeguards & penal provisions to punish the implementing Agency have to be inbuilt in the existing and new legislation
Demand-9. The Central and State Governments should insert the necessary safeguards in all Laws (in the Law itself),to punish the officers for dereliction of duty, for example if the Municipal Law prohibits commercial buildings in Residential areas but such buildings do come up then the concerned Engineers and other officers , entrusted for their prevention should face severe punishment of at least seven years in Jail immediately as well as termination of service, similarly if a Revenue Inspector fails to report an encroachment on public land immediately then he should face same penalty immediately. Provide for capital punishment for corruption.

Problem-10. THE NAREGA ACT, 2005 (Gramin Rojgar Guarantee Act) for purpose of giving guaranteed employment to the rural poor will most certainly break up the Rural households and the joint family system prevailing for millions of years due to the wrong definition of “Household” which means the members of a family related to each other by blood, marriage or adoption and normally residing together and sharing meals or holding a common ration card; Thus if a Householder is living together with say
His three sons & their wives as well as his own minor children as well as
those of his sons then only one of the entire lot will be entitled to Employment Guarantee of hundred days and if the House hold breaks up and the Sons start living separately then at least four of the lot will be entitled. Now what will this do, is, either break up the family or force them to get separate ration cards, live together but lie about it and bribe the Pradhan and in short become a thief in the eyes of the Law.
Demand-10. I therefore demand from the Central Government to make the necessary change in the definition of the word “household" in the THE NATIONAL RURAL EMPLOYMENT GUARANTEE ACT, 2005 so that it does not lead to breaking up the Households or to converting millions more (poor rural citizens), to the already a very large community of Liers & thieves which we, Indians already are. The word Household or family should mean “husband, wife and minor children only” as it is defined in all other laws.

Problem-11 Article-14 of the Constitution has to be properly redefined, If Mulayam Singh is the C.M, he pumps in thousands of Crores in to an obscure Village Saifai, which is his constituency and his Home District is freed from power cuts. If Sonia is in power, the Central Government pumps in thousands of Crores worth of projects in her Constituency, Similarly Railway Ministers from Bihar provide hundreds of Trains to Bihar, ignoring the rest of the Country, at the same time hundreds of Parliamentary or Legislative Constituencies lack the most basic of facilities. What is this? Is it not might is right, the Uncivilized ways of the Barbarians.
Demand-11. The Planning Commission should be accorded Constitutional Status and the location of all projects of the Central or State Governments above (presently 10 Crores of Rupees) should be cleared by the Planning Commission after carefully analyzing the Statistical data of various constituencies and their need. The Politicians in power should not have the power to nurture their Constituencies at the cost of other citizens, of other Constituencies. If this is not done then just as States are breaking up alleging discrimination against one region or other, there will be hundreds of other break-ups threatening the Unity and integrity of the Nation itself.

Problem-12 The Hindu/Sikh Community is being discriminated against in all Islamic Countries of the World, Jajia Tax is being levied on them, their Houses are being seized, their lives and properties are at constant risk at all times.

Demand-12. The Government of India should issue an open invitation to All Hindus/Sikhs of such Islamic Countries, like, Pakistan, Afghanistan, Bangladesh, Indonesia, Malaysia etc to come and settle freely in India.

Nations can fight wars & still Survive; Nations can fight Disease & still survive: Nations can fight hunger & survive.
No Nation, which does not, ensure, Justice to its Citizens can ever Survive.
When a few Railway accidents happen, there is a hue & cry & the Resignation of the Railway Minister is called for:
When a few riots take place, the resignations of the C.M, P.M, Home Minister are demanded & in the past a few Politicians did resign taking moral responsibility for the failure although they themselves were not rioting.
After the China War debacle, the Defense Minister went although he was not on the front , fighting.
There is total failure of the justice System in the Country, with millions of cases pending & millions of uprooted Farmers are not able to get their Land Acquisition Compensation as their cases have been pending for decades at various levels.
Millions have died waiting for justice and yet their cases are pending and their dues gobbled up by the respondents, with the Government itself gobbling up billions of rupees being the biggest litigant.
Still many millions, victims of heinous crimes have died, their souls waiting, for punishment of those who killed or maimed them. The President of India, K R Narayanan on 28-01-2000, while speaking on the occasion of the Golden Jubilee of the Supreme Court of India said “That even now Justice is not available to the poor….That is why it is said that Courts are Casinos, where a lot depends on how you throw your dice…..If the Citizens do not get fair & affordable justice then … they may instead of following the rule of law, take the law in to their own hands”.

At various forums, the Chief Justices of India as well as other Hon’ble Judges have voiced their concern saying that the Government is not appointing the required number of Judges and is also not giving the required Infrastructure. It is true that at least ten times the present strength is required. In Pakistan having just about 15 % of population as compared to India , there are about nineteen serving Supreme Court Judges while our Constitution provides for a maximum strength of about 27 or 28 instead, it ought to have provided for a minimum number rather than for maximum.
The result is that many languages and states of the Country may not even find representation in the Supreme Court. Thus from the beginning it seems the Rulers did not want the Country to have an effective Judiciary. All the essentials of life i.e. Education, Health Services, Land for Housing and Occupations, in Cities have been allowed by the Governments to fall in to the hands of the Mafia and it is not providing Infrastructure for an effective Judiciary.
Out of the above, The Government is the biggest Mafia, controlling Land, specially Urban Land, acquiring it at throw away prices on a large scale & thereafter hoarding it and releasing it in small quantities, slowly, driving up the prices and profiteering, a la- Sukhhi Lala of the Film Mother India who used to hoard the grain and then ask for the Honor of the women who wanted grain to feed their Children.
There has grown an all pervading Sense of Gloom and In-Security amongst the Masses in the Country.
The Senior Officers of the Army are being charged with crimes of selling off petrol during transportation & instead, carrying water in its tankers & dumping in the fuel dump(case reported from Jammu recently) then there was the News of selling off of subsidized Liquor of Army Canteens, in to the open market by Army Generals. There has been embezzlements in purchase of Army Rations, Pulses and meat & underweight Eggs as well. Such a situation is deplorable but how does one expect a well read, sophisticated Army Officer to pay for the professional education (Medical/Engineering/MBA) of his Children which can presently cost about Rs twenty-thirty lakhs per person in India. How can he buy a House for himself which in keeping with his status can cost upwards of several Crores in a good-sized City. We are not paying him that kind of a Salary? Therefore by allowing for large-scale speculation in land as well as surrendering the Education & Health services to the Mafia forces the Governments have destroyed the Institution of the Army as well.
Therefore I am aware that alongside the suffering masses of India, People of the Judiciary are also the Victims of the wrong policies of the Governments and many of the Judges at the lower Court Levels along with the Advocates practicing there are also struggling to meet both ends meet. The same may be the situation with respect to many advocates in the High Courts of a few Northern States and even the Judiciary is not free from this sense of Insecurity.
Other than the resignations en- masse by the Judges of the Supreme Court and the High Courts, there is no other way to force the Government to provide for at least ten times the number of Judges as well as the required Infrastructure. That is the only way by which the Governments will be pressurized to act.
Therefore I appeal to those of you , who, have the financial security of their own and not dependant on the Government for it & who have their Children well settled in life, to resign & force the Government to provide the Required Infrastructure & fix a time limit for disposal of various types of cases so that at least 95 % of the cases in all the High Courts/Supreme Court/Consumer Commissions /Consumer forums are decided after full study of files, in maximum 100 days and at least, 95 % of the cases in the lower Courts are finally decided in maximum 200 days.
Although in the past I have said many uncomplimentary things about the Judiciary but recent happenings have made me think again. As per News Item dated 28th October-2007, in the presence of the Ex Chief Justice of India Shri V. N. Khare, it was observed that the Rulers want to keep the Judiciary handicapped by not providing the required Infrastructure. In view of the above I have decided to Appeal to your good Conscience. I have further decided to devote the rest of my life to achieve the above Objective & raise my voice & undertake a Nyaya-Yatra, to secure Fast & efficient justice for all in India.
This letter is being sent first to the Chief Justice of India only thereafter it will be sent to other Judges.

1. Something needs to be done urgently to leash the Rogue Media in India, the example of recent Terrorist attacks is a case in point ,where the Media went overboard and exposed the Foreign Tourists and Security personnel to great risk, by reporting their status, position and strategy , which the Terrorists saw live on TV or mobiles.
2. The public trial of criminal cases by the media is another case in point, where the reputations of thousands are tarnished daily by this Rogue media.
The most important point is that the Media Houses, especially the established Print media groups are mostly owned by Lalas, Baniya families, who have hundreds of other business interests and they are using their media clout to blackmail the Establishment and Politicians to further their questionable Business interests, some of them have themselves become Rajya Sabha or Legislative Council members. Many of them are Land Mafia elements and they enjoy the Government Patronage in grabbing Lands.
3. There is the old saying, CHOR, CHOR MAUSERE BHAI (thieves are like cousins), I openly throw a challenge that if the owner of a media House or an established Reporter were to openly indulge in Rape, not a single line about the incident will be carried by any Media house or Newspaper.
The media is supposed to be the fourth pillar of democracy therefore it is essential that the Reporters should be paid in accordance with their needs to maintain a reasonable status so that they can report the truth and thus ensure the dignity this fourth pillar. As against this the Reporters of Newspapers (particularly Hindi Newspapers) are paid paltry amounts, with the result that most of them actually are and act like Bonded menial laborers of the owners and are in fact engaged in advancing the illegal trades of their owners, rather than advancing the cause of the Fourth Pillar of Democracy.
In a recent incidence, when the owners of the Dainik Jagran Group, one Mahendra Mohan Gupta, Rajya Sabha M.P, in order to force me to withdraw some public interest petitions, filed by me (raising the issue of grabbing of Cremation Ghat Garden and other Public Parks by their group company and Society, for using for their Commercial ventures), got a false FIR lodged against me (by a person whom I have never even met or ever knew and for this purpose they engaged the services of a so called Labor leader but actually a Mafia element Ramji Tripathi, who runs a Illegal Guest House in residential area and also has an illegal Market and for all these he has been stealing and using electricity directly from the pole. Presently , under the garb of Ganga pollution, he has been extorting money from Tanneries of Kanpur) under SC ST and other Acts, I met senior reporters off Amar Ujala, Hindustan, Tehelka and all other Newspapers and wrote to about a hundred more Media Houses, not one, agreed to carry a single line in my support and at the same time the Dainik Jagran carried reports almost daily to pressurize the Police to send me to Jail. Their Reporters, one Adesh Tripathi and another one carried the False complainant against me in the Groups Car and Paraded him (and exhorted him to give false statements, telling him that he had nothing to fear for his falsities as the full might of the media giants, the Dainik Jagran group was behind him) before the Police Officers.
REMEDY
Therefore something needs to be done to free Journalism from the Clutches of these blood sucking vested interests and Media Barons. (i)- Firstly, by a suitable Legislation. Media Groups, their owners, their relatives etc should be prohibited from entering or carrying out any other Professions or business interests just as the Advocates are barred from carrying on any other business or professional activity other than that of an Advocate.
(ii)- There should be a pay commission for journalists and the pay scale and benefits of Reporters should be fixed at par with at least that of an High Court Judge, if this pillar of democracy is to be saved, needless to say that standards for minimum qualifications of Journalists as well as the Institutes imparting Journalism courses also need to be set. (iii)- Stringent Penal provisions to punish yellow Journalism and media trials. (iv)- An Autonomous Press improvement Body should be set up to encourage forming of Cooperative Societies of Journalists and other Media professionals, which in turn should be encouraged to set up Media publishing Houses and for this purpose, easy and interest free loans for plant and operational expenses should be advanced to them so that at least the first three years expenses are taken care of.

I hope that the Government will do something to check the Malaise

Please be informed that all the security apparatus of the Country has been monopolized by the State and the people are left to die on the streets.
Please tell me would the Terrorists have dared to engage in Mayhem in Taj or Oberoi or the other places if they felt that in these places there would be hundreds of guns in the hands of the people visiting them and these guns would be firing back at them. Will any dacoit or thief ever jump in to your Home if he knew that there may be three or four weapons firing back at them from your side.

All the Citizens should be issued, on demand, Arms Licenses for their protection( instead of the present practice of issuing licenses on political patronage basis) & hand-arms should be imported & given free of cost to all the citizens so that they too can have some protection for their lives.

To All the friends working for the RTI cause in particular and for removal of Corruption from the Country as the larger goal.

Subject: False FIR No.378 of 2008, filed against me in Panki Police station of Kanpur on
the directions of the Dainik Jagran Newspaper group Owners.

Dear friends
As you are aware that I have been trying to protect the Parks, green areas and other heritage of the City of Kanpur in particular and the State of U.P. in general.
The Owners of the Dainik Jagran group of Newspapers entered in to a conspiracy with the Kanpur Development Authority Vice Chairman N. N. Prasad in 1999 and with the help of the then Minister Lalji Tondon, managed to grab a five acres Land of the Biggest Cremation Ghat of Kanpur, i.e. Bhairon ghat, which had been given by the British for plantation of Ornamental flower Plants and Herbal Plants to guard and protect the Sanctity of the Cremation Ghat.
Thereafter a beautiful Herbal Garden came in to existence on the Site and was known as Ayurvedic Garden. In the Master Plan of Kanpur made and enforced in 1970,the entire Land including the existing Elgin Mills Bungalows was reserved for the purpose of Cremation Ghat /Ayurvedic Garden green area.
In 1999 the then Vice Chairman , N, N, Prasad handed over the Garden to the Dainik Jagran people and they constructed a Multiplex Known as RAVE-3.At that time the K.D.A V.C concealed the Master Plan Status of the Land from everyone including the State Government Officers and even the District Collector also and allotted it to the Jagran people for Cinema halls/Multiplex.
How three Picture Halls and entertainment Complex as well as Shopping Complex could be built on the Cremation Ghat. It is only the greed of the Jagran group owners that resulted in the happening of the blasphemous activity on the Resting place of the dead.
Therefore actually a F.I.R should be lodged against the Jagran Owners, N.N. Prasad, Lalji Tondon and other officers of the Awas Department who connived in the crime against the City of Kanpur and the trust of the Citizens.
I filed a writ Petition No.20999 of 2002 in the Allahabad high Court seeking directions for demolition of Rave-3 Multiplex and for restoration of the Ayurvedic Garden on the site.
In 2002 itself they made attempts to buy me and having failed they threatened to have me murdered ,this they did through their Land Mafia crony friend Ramji Tripathi, who runs a illegal Tripathi Guest House as well as two market Complexes in Panki and for the last decade or so has been running them by stealing electricity also directly from the pole.
In 2003 this very group managed to get allotted a fully developed Park No.831 in Panki –B, Block for a College in the name of Sri parade Ram-lila Society and cut off about two thousand fully grown Trees and sold off Timber worth about fifty Lakhs Rupees. I filed another Writ Petition No.30203 of 2003 in Allahabad High Court praying for restoration of the Park.. Again I was threatened to be killed by Ramji Tripathi against whom I gave complaint letters in July-2003 to Panki Police Station but no action was taken.
In 2008 after the coming in to force of the Right to Information Act-2005, I got many documents from the Fire Department and Kanpur Development Authority which will help me in the cases in High Court. It came to light by the documents that the Rave-3 Multiplex had been operational from 2001 to August-2007 although the Fire Department of Kanpur had repeatedly declared it unsafe from Fire Safety point of view. It was and is Operational without the mandatory Completion certificate of Kanpur Development Authority and as against the permitted construction of 30% covered area for Commercial Purposes, they are using 67 % for this purpose., the Map was cancelled in January-2001 and the Compounding Map has also been cancelled.
Similarly Rave@ Moti has also been constructed Illegally in Residential Area and is Operational without the Mandatory Completion certificate.
In order to put pressure on me They have through Ramji Tripathi given a false complaint against me in beginning of May-2008, through a person of Scheduled Caste, one Ram Singh Sweeper, whom I have never met nor do I know him but it is alleged that I took two thousand rupees from him and promised him employment in Nagar Nigam and thus cheated him and then threatened to kill him when he demanded the money back.
I along with other RTI volunteers met the Commissioner, D.M, S.S.P. Kanpur and held a press Conference after which the Bureau Chief of the Dainik Jagran, one, Sanjeev Mishra, called the RTI volunteer friend Kuldeep Saxena to the Dainik Jagran Office and told him that either Robby Sharma should take back his cases from the High Court or they will phone the Panki Police Station In charge and have me arrested. All this matter was brought to the notice of the Commissioner, the D.M, the S.S.P and I.G. as well as the DGP and the Chief Minister in May/June.
Friends of the RTI fraternity helped me a lot and due to the efforts of the Senior Journalist Bobby Ramakant, the international media, Seoul Times, Thai Indian News, News Blaze etc high lighted the story as well as Assam Times.
Now tonight a Police Constable again came to my House and told me that the Case against me has been registered as F.I.R No.378 of 2008.This has as you all know been done due to the tremendous influence both political, media and money power of the powerful owners of the Dainik Jagran Newspaper.
The Police in the first instance was very considerate and saw the complaint as a totally false one, the Complainant did not even know my name properly and mentioned it wrongly in the Complaint, the complainant Ram Singh is Illiterate and got the Complaint written by one Subodh, again a person I do not know who said he was with Ram Singh when I threatened him (Ram Singh).
Therefore the stage is set, a Complaint has been filed against me alleging serious charges, by a person ,whom I do not know, Who himself does not know my correct name yet he claims that he gave me money (full two thousand rupees out of fifteen thousand demanded by me)to get him a Government Job, there is a witness Subodh again somebody I know nothing about.
There is a new S.S.P in Kanpur one Mr Hari Ram Sharma, whom I have not met till now. I am writing below the extract from Seoul Times of South Korea ,dated-18-may-2008.:-

Kanpur Land-Sharks Intimidate RTI Activist by Fabricating False Charges

Land-mafia in Kanpur in connivance with officials of Kanpur Development Authority (KDA) have slapped false fabricated charges against an Right-to-Information (RTI) campaign leader - Roby Sharma.
Roby has been spearheading the RTI campaign in Kanpur since past two years now, exposing corruption and championing people's causes across the city.
Roby had filed a RTI application seeking the information from the KDA and Fire Department officials on how many multi-storey buildings are following the fire-safety norms setup by them, and how many of these buildings have obtained a no-objection certificate from the fire department.
Roby had further asked under the RTI Act that under which government order, are the private guest houses and businesses conducting commercial businesses in residential localities.
Also in Panki region of Kanpur, a 'ramleela' park was allotted to build a private school. Roby had filed a RTI application seeking to know under which government order have the allotment been made.
Due to the connivance of land-mafia with KDA officials, there are many such instances of illegal and unauthorized land grabbing across the city of Kanpur.
KDA has not given a response to many previous RTI applications of Roby and the hearing of these cases are currently undergoing in State Information Commission (SIC) of UP.
Also media has been colluding too! A leading city newspaper owns two major multiplexes - Rave three and Rave five - both of which are functioning without a no-objection certificate from Fire department. The bureau chief of this newspaper Sanjeev Mishra had threatened another acquaintance of Roby to 'stay away from Rave' related cases. The bureau chief also threatened the acquaintance to get Roby arrested and 'rot in jail for rest of his life.'
When Roby Sharma went for a hearing in the office of KDA's Secretary Hemant Kumar Singh, another senior KDA official Mahaveer Singh had verbally abused him and threatened of dire consequences if 'Roby doesn't stop seeking information.'
"RTI Act is a much-heralded public interest constitutional policy empowering the citizens and bestowing them with their fundamental right to information in the democratic India. But rampant corruption, malpractices and nexus between the 'powerful' and mighty and authorities are posing a huge challenge to the committed RTI champions like Roby Sharma" said Mahesh Kumar, another leading RTI activist in Kanpur.
The activists today met the district magistrate of Kanpur who assured them of taking action.

RTI Act dead and buried in U P by Info Commisioners

No body seems to be bothered to go in to the actual problem of U.P. State Information Commission. most of the Information Commissioners are either discarded Government advocates of High Court (close chums of Satish Mishra, Mayavati's man friday).Please note and understand clearly that good for nothing advocates, who are unsuccessful in their practices, bribe the politicians to become Government Advocates. Now they have been appointed Information Commissioners by Mayawatiji so that these good for nothings can draw a lakh of rupees as salary. It is but natural that they will wag their tails to the tune of the Government.
Secondly two of the S I C's are Hindi Newspaper journalists, who generally are nothing more than blackmailers. It is only after the advent of the TV media that the Government's misdeeds in some cases are being exposed which these Hindi Newspapers were all the time sweeping under the carpet and getting fat on Government dole. Therefore what needs to be done is to clearly get the term "Persons of eminence in Public life" clearly defined in the RTI Act, Section-12-(5). which provides that CIC and other Commissioners as well as S I C's should come from this category and the Governor be sounded on this. Surely discarded Government Advocates of High Court can not belong to this category. Maybe eminent advocates like Nani Palkiwala, Soli Sorabji etc may qualify but how can persons like Subhash Chandra Pandey, Ram saran Awasthi, Gyanendra Sharma, Virendra Saxena, Brijesh Mishra, Sunil Chaudhary, R H V Tripathi, Major Sanjay Yadav qualify as persons of eminence in public life.
I still feel that initially (till the legal aspects of all the exemption clauses of the Act are settled, for which, high degree of legal Competence is needed ), the majority should comprise of reputed retired High Court or Supreme Court Judges coming from Non Government Advocates Cadre only and a few persons of real eminence in public life " like Anna Hazare, Sandeep Pandey Rajendra Singh, etc.
I have been to the Commission on at least a dozen occasions and found a all pervading sense of hostility towards the Applicant Information seekers there. They have for all practical purposes killed the RTI Act in U.P. they have been disposing off cases at their own sweet will. They have even fixed their working hours from 11 A.M to about 1400 hours. Even the High Court and Supreme court have not taken the liberty of starting at 11.00 A.M. There is no registration of applications for certified copies of the Orders. The applicants are asked to fill in the application for copy of order , fix rupees ten stamp and one Rs one stamp and drop it in a box. The applicants who come from far off places have no means of knowing whether their applications for copies of orders are ever registered or simply thrown away after removing the stamps. Although the Commission is given power of Civil Court but it has not bothered to note that in civil Courts, Applications for copies are given registration numbers and a record off all such applications is kept and the applicant is aware of his application’s registration number, I myself applied for a copy of order passed on my application on 22-may-2008, all records disappeared and I never got the copy. I applied for copies of order dated 5th august 2008, passed by Chief SIC on two of my applications on 5th of August-2008, the copy was not ready even on the 15th of September when I went for yet another hearing. On 15th of September, the Chief Information Commissioner Gyanendra Sharma clearly told me that it was not his and the other Info Commissioners Job to read the Applications. I was sitting in his office for about three hours waiting for the PIO of the concerned department to come although my application was listed at serial No.1 and all the time he Gyanendra was telling the P I O’s of the concerned departments to use such and such section to deny the information and same thing he told the PIO of the concerned department relating to my application.
The commission after receiving the Application fixes the first date of hearing after about three to four months of receiving it. The notice of hearing, which is sent by ordinary post (mostly it is never sent to the Applicants I myself never received the notice regarding at least 50 % of my applications, again why the Commission does not send by registry is a mystery because the Civil Courts always send notices by registered A.D. post. The intention is clear they want to decide as many cases as they can in the absence of Information seekers.
Although in majority of the cases the Information even if given is delayed and as per the Act such delay attracts penalty clause, which is mandatory and even if the applicant is satisfied by the Information but if the same is given after delay then too it is mandatory for the Commission to issue show cause notice regarding the delay and only if the Commission is satisfied by the reason of reply, then and only then can it waive the penalty. This clause is the back bone of the Act and was inserted so that the Public Authorities take the Act seriously. In all the cases before the Commission it has not even issued show cause notices in even 5 % of cases (Out of about one dozen of my applications wherein I was never given the Information or if given, it was delayed by many many months and even a year, only on my insistence was show cause issued in only one case in which the PIO of PWD department fabricated back dated replies and when on my insistence he was asked to produce receipt of registry, they on 01-09-2008 produced a peon book in which the reply was shown to have been given at a address, which was not mine and even the Peon book was not original, a piece of plain paper was pasted on it and photocopied however the Noble and all knowing Information Commissioner Ram Saran Awasthee found nothing wrong in this forgery and did not impose penalty).
It is a common occurrence that in many cases, two complaints are registered on one application rendering both as illegal. This happens due to poor upkeep of applications/appeals. I had sent one Appeal on 23rd April 2008, in two copies, the receipt of the Appeal was recorded in the register on 23rd April, but the same was again recorded in fist week of May-2008 resulting in two appeals being registered on one application. The result was that I got intimation by ordinary post in one of the two Appeals . S-1-2406 ( C) /08 & fixing 1st July-2008 and went to attend the same on 1st of July-2008 in the Court of the Chief Commissioner Mr Khan , who happened to be absent, so attendance of the parties was recorded, My attendance was recorded and the date was given as 5th of August-2008, the PIO of the concerned department was absent. On 26th July I was shocked to receive a letter No.22009/SIC/08 dated-22-7-2007, which contained an order passed in Complaint No. S-1-2763 (C )/08 on 14-07-2008 passed by the Hon’ble Commissioner Mr S.C. Pandey in this letter I was informed that I had absented myself from the hearing on the 14th of July-2008 & the Opposite party was present and had told them that they had repeatedly asked me to deposit the Fee of Rs-682 for the Information, which I had failed o deposit & as such I was advised by the Commission to deposit the fee as required and get the information & 5th of August was fixed as the next date. I never got any intimation of the Complaint case No.S-1 2763 (C) /08 & thus had no occasion to attend the hearing.
Now the fact of the case was that in spite of the fact that by some mistake, two complaints had been registered on one Second Appeal & in spite of the fact that I was absent due to lack of knowledge, still, had the Hon’ble Commissioner taken care to read my Appeal, which was most concise, short & specific, he would have not passed such an order because the Appeal mainly was in protest about the demand of fee for Information which the Complainant could not be forced to pay for Information in view of Section-7-(6), read with Section-7-(5), as the Letter asking for it was dispatched by them much after the Statutory period of Section-7(1) & 7(3)(a).Thus the Information Commissioner S.C Pandey never bothered to read even a very short appeal filed by me resulting in more delay and complications.
Therefore for all practical purposes the RTI Act in U. P is dead and buried unceremoniously by the State Information Commission.

Respected Sir:
1. THE NATIONAL RURAL EMPLOYMENT GUARANTEE ACT, 2005 NO. 42 OF 2005 presumably enacted for the laudable purpose of giving guaranteed employment to the rural poor may not achieve the primary objective but it will most certainly ensure that every Gram Pradhan will earn a few millions, and every Block Development Officer and other Government functionaries including the District Magistrates will most certainly add a few millions to their Bank balances.
2. What this Act will most certainly achieve will be to break up the Rural households and the joint family system prevailing for millions of years will be the casualty.
3. The Object of the Act provides:-
An Act to provide for the enhancement of livelihood security of the households in rural areas of the country by providing at least one hundred days of guaranteed wage employment in every financial year to every household whose adult members volunteer to do unskilled manual work and for matters connected therewith or incidental thereto.
4. Section-3 reads as below:-
3. Guarantee of rural employment to households.-(1) Save as otherwise provided, the State Government shall, in such rural area in the State as may be notified by the Central Government, provide to every household whose adult members volunteer to do unskilled manual work not less than one hundred days of such work in a financial year in accordance with the Scheme made under this Act.
5. The definition of “Household” is as below:-
(f) "household" means the members of a family related to each other by blood, marriage or adoption and normally residing together and sharing meals or holding a common ration card;
6. What this means is that if a Householder is living together with say
His three sons & their wives as well as his own minor children as well as
those of his sons then only one of the entire lot will be entitled to Employment Guarantee of hundred days and if the House hold breaks up and the Sons start living separately then at least four of the lot will be entitled. Now what will this do, is, either break up the family or force them to get separate ration cards, live together but lie about it and bribe the Pradhan and in short become a thief in the eyes of the Law. It is only due to these foolish legislations, which turn every body in India into a thief that I had named my Blog as “INDIA MANUFACTURER OF THIEVES”.
7. There is no effective provision in the Act to contain corruption, in fact there is no such
provision in any Legislation in India for this purpose as already written by me earlier “ It is
submitted that all legislation in India were based on the principle that those implementing it
will be absolutely fair & that is why most of the legislations are failing presently because the
implementing agencies are found to be wanting in honesty & fair play hence if any legislation in
India is to succeed then, while framing it, it should be kept in mind that the implementing
agency is most likely to be totally corrupt & therefore for this purpose necessary safeguards &
penal provisions foe very stringent punishment of the officers of the implementing Agency
have to be inbuilt in the legislation.
8. I suggest that a compulsory subject, in lieu of Mathematics, titled as “Social Audit” should be
inserted in the curriculum at High School and higher levels and the students (in groups)
should be taught, trained by experts & required to conduct Social Audits and verify the
various works executed by Government Agencies, including those executed under National
Rural Employment Guarantee Scheme so that a permanent Social Audit network is there in
place all over the Country. Engineering students should be compulsorily required to undertake
one year internship (like medical students), before getting the degree and during this period
they should render assistance by their expertise to the students of “Social Audit” subject in
their work of conducting of Social Audit & verification of Government works. IIT students
should similarly be asked to do the Social Audit of high value Government works, like Roads
Construction etc so that corruption in these works may be curtailed.

I therefore request you to make the necessary change in the definition of the word "household" in the THE NATIONAL RURAL EMPLOYMENT GUARANTEE ACT, 2005 NO. 42 OF 2005 so that it does not lead to breaking up the Households or to converting millions more (poor rural citizens), to the already a very large community of Liers & thieves which we, Indians already are.
