The Allahabad High Court full Bench while deciding the greater Noida and Noida Extension-NOIDA Land acquisition cases on 21-10-2011 has issued a direction which will enrich the officers of the NATIONAL CAPITAL REGION PLANNING BOARD beyond their wildest imagination. The Builders in order to get their projects approved will have to get the Master Plan 2021 of NOIDA approved by the NCRPB and every one knows that the NOIDA Authorities are not going to grease the palms OF THE NCRPB officers for the purpose so it is but natural that the BUILDERS will be forced to step in. Rest assured the NCRPB will approve all the projects as in India everything everyone is for sale.The relevant direction of the Allahabad High Court is as follows:-

“5. The Greater NOIDA and its allottees are directed not to carry on

development and not to implement the Master Plan 2021 till the observations and directions of the National Capital Regional Planning Board are incorporated in Master Plan 2021 to the satisfaction of the National Capital Regional Planning Board. We make it clear that this direction shall not be applicable in those cases where the development is being carried on in accordance with the earlier Master Plan of the Greater NOIDA duly approved by the National Capital Regional Planning Board.”

The judgment of the Allahabad High Court although correct in dismissing the cases filed years after the Acquisition is very very strange indeed with regard to cases where the Builders carried on developments in spite of status quo orders of the Court. The Court has ignored the contempt of its own orders and given no relief to the Writ Petitioners of these Writ petitions. Satish Mishra is indeed a great fixer of Judiciary and that is the only reason that he is so close to Mayawati ji.

This Judgment , by which relief has been given to builders and Allottees of plots solely on the ground that they are third parties and as such third party rights need to be protected. Now what this Judgment means is that some dacoit can rob you and then sell your property to say ten people and when the Police catches him then you will not get back your property as third party rights have been created by the robber selling the goods to these ten people. Now is it what actually happens? Answer is …. No. In such cases the Police even arrests the buyers of the stolen property. So indeed the Judgment is ridiculous. So what should have been done is that the Land which was fraudulently acquired (stolen) from the land owners, who did not take any compensation should have been restored back to the owners (irrespective of the fact that 60% or even 90 % Land owners had accepted the Compensation) and the Builders and Allottees of NOIDA Authorities should have been given the option of recovering their damages from the NOIDA/Greater NOIDA Authorities and the Court fee for the purpose should have been hoisted on the NOIDA Authorities. That would have been Justice.

Respected Anna Hazare Ji Please beware of False Prophets and so called God Men as they are none other than Corporates and the only difference between them and other Corporate Sector is that the Corporate Sector pays taxes while these False Prophets and so called God Men do not pay any taxes.

Please remember that they have made an appearance after seeing the massive Crowds gathered in your Support since early Morning on Sunday. They may be the agents of the Government and please understand that they neither have the good of the Country in their hearts nor your welfare. They are also very jealous of your popularity, had they really cared about the Country, then instead of just visiting you in Jail, they would have given a call to their followers to fill the Jails on the day of your arrest itself and should have gone to Jail themselves. Please also understand that you live in a Room of 8X10, while their Bathrooms are five times bigger than your Room and their Bank Lockers are even bigger.

Please remember I have never seen a God Man in India kick out any Bureaucrat or politician saying that “you are corrupt” instead they are given VIP darshan and special Ashirwaad and in turn they get Crores of Rupees, Land for their Ashrams and standing instructions to the authorities to look after them. 1. The latest news is that Ms Aruna Roy has come forward with another Lok Pal Bill and she claims that Anna and his team are not the only Civil Society in India.

2. Well Aruna Roy Ji I would like to tell you that the people of India will recognize the Team Anna as the Civil Society of India because they have been advancing the cause since long and their team Members have gone on fast and endangered their lives not once but several times.

3. So Aruna Roy Ji do you wish to say that we should also wait for your Children to grow up and stake a claim to being the Civil Society after say about ten or twenty years.

Aruna Roy Ji please note that you no longer belong to the Civil Society in fact now you belong to the Ruling Society being a member of the National Advisory Council a team headed by the Mother Hen of Corruption Ms Sonia Gandhi. It is only at her instigation that you have come forward to sabotage the people’s movement led by Anna.

Another meeting on the Jan Lokpal Bill at Nehru Memorial adjoining the historic Teen Murti Bhavan saw civil society members voicing apprehensions on the unlimited powers that the Lokpal would enjoy if an anti-corruption Bill, as envisaged by Hazare-Kejriwal group in the joint drafting committee, becomes a reality.

“The attempt is not to junk the Bill but we don’t want to create a Frankenstein either,” leading social activist and member of Sonia Gandhi-headed National Advisory Council Aruna Roy said at the meeting convened by social rights group NCPRI. “Absolute power corrupts absolutely,” she warned.

According to NCPRI member Shekhar Singh, accountability of the Loppal is exceedingly important. “Not just for the 11 persons at the top but at the level of vigilance officers in districts, where it may become the most lucrative post to hold,” he says. Ever since the agitation started, differences have emerged with the Hazare-Arvind Kejriwal group, which wanted its version of the Jan Lokpal Bill to be the basis of discussion with the government. An issue on which it particularly does not agree is the setting of deadlines, first for the Bill to be finalised and then passed by the Parliament.

The Aruna Roy-led Mazdoor Kisan Shakti Sanghtan has asked for “broad public consultation, across groups and regions” to precede the joint drafting of the Lokpal Bill by civil society and UPA Ministers. There is a need for a strong anti-corruption bill but not at the cost of quality, Roy says, emphasising on need for large-scale public consultations and, more importantly, accountability of those who were being entrusted to hold others accountable through the Jan Lokpal Bill. “Other people who are interested in the Bill should generate discussions and present it to the government,” she adds.

Incidentally, members insisted that today’s meeting should not be termed as a “parallel meeting” since it had been planned much earlier. Roy said today’s meeting had originally been planned as a meeting of NAC’s Working Goup on Transparency and Accountability meeting on NAC, which was earlier shelved.

Three earlier essays on “the Hazare phenomenon” enlarged on the duplicity involved of Hazare and company in their crusade against corruption.[1] The essays noted, in particular, the shady financial dealings and absence of transparency and accountability in the publicly-presented accounts of the NGOs of Hazare & co., though they demand transparency and accountability from others. Scanned were data in the public domain of Anna Hazare and his NGOs, Arvind Kejriwal and his NGOs, Kiran Bedi and her NGO, Swami Agnivesh, Mallika Sarabhai, Shanti and Prashant Bhushan, Medha Patkar, Aruna Roy and Harsh Mander. Justice Hegde’s association with the politically-biased Hazare & co., while still Karnataka State Lokayukta, was questioned. Noted too was the gross hypocrisy of their alignment with the person publicly described as the source of corruption in India.

In “The ox calling the donkey horned”, Aruna Roy was quoted on the Jan Lokpal Bill drafted by Kejriwal with support from Hegde and Prashant Bhushan. She called it “a Frankenstein’s monster that will devour all of us”. Aruna Roy is Convener of the Government of India’s National Advisory Council Working Group on Transparency, Accountability and Governance. She is thus Sonia Gandhi’s NAC mukhota in the war against corruption, just as Anna Hazare is Kejriwal’s PCRF’s IAC’s mukhota.

Dear Anna Hazare Ji here is what I think you should do next to take forward your struggle to rid India from Corruption.

The Elections are coming the first one being in Uttar Pradesh next year Please give a call to the people of the Nation to boycott all the present political parties and make a call to the ordinary Honest Citizens of the Country to fight the Elections as Independent candidates and out of these please back the Candidates who meet the following standards and agree to the following conditions:-

1. The candidate seeking your Approval should be able to pass a Narco Analysis test as well as a Lie Detector test to ensure that he/she does not have any Black money and is not indulging in any Criminal Activities.

2. The Candidate Seeking your Approval will have to agree that he/she will if elected agree to undergo a Narco analysis and Lie Detector test every three months to ascertain if he/she has indulged in any Corrupt practices during that period.

3. Your Team should make New Laws and Amend the existing Laws in public interest and all the Candidates enjoying your support shall be obliged to pass these Laws in the Legislature/Parliament.

4. If any Candidate after being elected fails to abide by these terms then you should give a call to all the people of the Nation to boycott that candidate for ever and for a Social boycott of his entire family.

5. Your team should immediately decide about the amendments which need to be made to the Constitution in public interest so that the coming generations may be protected against corrupt Governance.

6. Please make Constitutional Amendment to provide for periodic preferably every three months Narco Analysis and Lie Detector tests of all the Bureaucrats and Ministers to find out if they have indulged in any Corruption during the period. If Science can be made to save human Lives then it can also be used to free the Country from Corruption since at time of the Making of the Constitution and the Indian Evidence Act, the Lie Detector Tests / Narco Analysis tests were not known , they have to be included now as the truth has to be found at all cost.

7. Your team should lay down the Qualifications for election as Legislators/Parliamentarians and lay down the age of retirement of politicians, in these qualifications. The whole concept behind the Retirement Age is that after a certain age, both physical and mental alertness decreases therefore if a Supreme Court Judge is retired at 65, an Army General at 60 and other Government servants also at about Sixty then how can the Politicians be allowed to continue after Sixty five ? are they a better specimen? Just imagine a scenario where there is a nuclear attack on India late at Night and some Old aged Prime Minister of say above Seventy is awakened, he will be incoherent for a long period of time and then may be he may be able to gather his wits around him, then may be he will not even be able to stand on his quivering arthritis stricken legs by then it may be too late. If medical certification of fitness is given as an excuse then the same should apply to the Army Officer/Judges and other Government officers also as they in any case have lesser responsibility/decision making power than the Ministers/P.M.

8. Make a new Law to subject all the present Ministers / Prime Ministers and Bureaucrats as well as those who have retired during the last ten years, to a Compulsory Lie Detector Test as well as a Narco Analysis test to find out about the black money stashed by them and then to recover the same and punish the culprits. In case of the Deceased out of the above category their heirs may also be made to undergo these tests.

9. Please note that All new Laws in India as well as the existing Laws are failing in India as the Implementing agencies are totally corrupt and these laws were made by the British and later on by Indian Politicians assuming that the Implementing agency will be totally Honest while the Opposite is true and to prevent the misuse there are no safeguards in the Laws. Had these Laws been made with the assumption that they will be implemented by corrupt officers then there would have been safeguards in all the individual laws themselves to prevent their misuse, the Provisions of IPC are inadequate as even the supervising officers all the way to the top are corrupt.All new Laws which are made and All existing Laws should be amended, and it should be ensured that they are made or amended keeping in mind that the Implementing Agency is likely to be totally Corrupt and to prevent the misuse or disuse of the Laws, provisions should be made in to all these Laws itself providing for stringent penalty for Omission as well as for misuse. For example if it is the duty of the Municipality to ensure that there are no stray Animals(cows, Dogs Pigs etc) on the Roads then if say some individual or some Organization finds say Fifty strays on the Road then the Officer responsible should be deemed to have indulged in Corruption (Omission has to be treated as Corruption otherwise no Law will ever succeed.) and then there should be provision for his imprisonment of at least three years as well as termination of service. Similarly if say ten Illegal Building or ten cases of Illegal User of Land is found in any given area/Zone in a city then the Engineer/Officer responsible for preventing this should be deemed to have indulged in Corruption and should be deemed to be in Collusion with the Law breakers and he should be imprisoned for minimum five years as well as terminated from service. Similarly if there are found to be say three encroachments on some village common land, unreported by the Patwari to his superiors, the Patwari should be deemed to have colluded with the land grabbers and should imprisoned for three years as well as thrown out of service. If however the Patwari reports the Illegality then after being reported by the Patwari, his superior officer fails to act within three days then he should be deemed to have colluded with the encroacher and should be imprisoned for seven years as well as terminated from service. The higher the post the greater the punishment.It is impossible to control or prevent Corruption just by The Prevention of Corruption Act as the Corrupt do not give advance telegrams to the Authorities declaring that they will be taking bribe on such and such date at such and such venue so please come and catch them red handed therefore Omission beyond a reasonable limit has to be treated as Corruption, the only thing to be kept in mind is that a reasonable exception has to be made such as if there are only say ten Stray Animals or only three Illegal Buildings/Land User in his Area then the Officer may be allowed to make amends by removing the Illegality but a warning should be issued to him and entered in his C.R.

10. In the next part I will give suggestions to prevent the Corruption at lower levels of the Government.

To day the entire Country was up in arms literally in Support of Anna Hazare after his arrest but not a squeak was heard from Kolkata / West Bengal after all their dearest Mamta Didi , to whom they are emotionally attached due to the 30 year misrule of Marxists is a member of the Criminal Gang of UPA . The Bengalis react emotionally, the only time I remember they reacted was when India nearly lost their World Cup semifinal in 1996. They always reacted whenever Ganguli to whom they are emotionally attached lost his place in the Indian Cricket team. Therefore for Kolkatta and West Bengal to react in your favor Anna you will have to die in Jail and then they will react more than at any other Place in the Country. So Anna please die in Jail please please die because I want to see West Bengal and Kolkata in the main stream of the Nation. I sometimes feel that lately there has been a dearth of the revolutionaries in Bengal a area which produced in the past such revolutionaries like Subhash Chandra Bose, Surjya Sen , Vivekanand, Khudiram Bose, Kanu sanyal and many others with the exception of Dr Vinayak Sen a true patriot or is it that between themselves the CPM and Mamta have managed to destroy the spirit of the Bengalis .
The good news coming on 21-august from Kolkata is that the P.M has BEEN BOOED AND TOLD TO GO BACK BY KOLKATTANS, THAT IS THE SPIRIT I WANT IN KOLKATA.

Dear Country men I feel that Kapil Sibbal, Digvijai Singh, Pranab Mukherjee and P Chidambram are proving to be the Varaah Avtars of the Gang of Indian National Congress in power in India. They are trying to extricate (imitating the Varah Avtar of Vishnu, who extricated the Earth from the Ocean for the betterment of the living beings) the Congress party from the Dirt and Shit in which the Congress party has fallen, however these Avtars of Congress are making efforts just so that their Gang can continue to loot the people of the Country as it has been doing ever since Independence.

Just see and look closely at their faces and see how their evil deeds are reflecting on them Kapil Sibbal, Pranav Mukherjee and Digvijay Singh all three’s faces Resemble a Varah and as for Chidambram, he resembles a tall but ill fed varah. If you agree then email me.

As far back as 27-03-2006 in my post titled 2030-INDIA-the biggest Brothel & human organs market of the World , I had clearly written about the Gangs in India as under:-

Look at Uttar Pradesh Sachivalaya (Secratariat) it is more of a Veshyalaya (Brothel),with hundreds of call girls plying their trades there, meeting Secretaries & Ministers ,lobbying for the interests of their businessmen clients who send them their to get their works done.”

Lately after the Supreme Court Collegiums took over appointments of Judges in the higher Judiciary, there are some people friendly Judgments in say about one percent of the cases but the higher Judiciary is weighed down by the Lakhs of anti people Judgments delivered over the years earlier when the Higher Courts were full of anti people Judges and their only qualification to be appointed was Arse licking of Politicians / Government. These Judgments were delivered by bigger benches of 4 or 5 or even more Judges as at that time there was very little work for Supreme Court Judges and greater number were free to sit on Benches and hear cases. As against that, now only two judges hear the same type of cases as such they can not over-rule the earlier foolish anti people Judgments delivered by larger Benches. The only solution lies if the present Chief Justice ensures that all cases are heard by not less than Seven Judges so that the earlier dirt can be cleared.

The Government keeps on shouting that the Parliament is Supreme and that Anna Hazare and others are trying to blackmail it and all their acts are unconstitutional. Now does the Government wish to say that once it gets a majority, its Gang gets a License to loot the Country and trample upon the General Public as long as the Gang remains in Majority.

The recent case of Karnataka is a case in point, where the Lokayukt found the Chief Minister and some of his Ministers guilty of corrupt practices and even after that B.S. Yedurappa remained defiant saying he enjoyed the support of the majority of legislators (it was only after the National Leadership of BJP swung in to action that he resigned but on his own terms and his man was made Chief Minister and mark my words were it not for the ongoing agitation of Anna Hazare and Baba Ramdev against corruption then even the BJP would have remained mum because it too is a Gang remember the serpentine Queues of favor seekers for petrol pump and gas agencies during P.M ship of Atal Bihari Vajpayee , who were obliged in thousands.

Therefore if the Constitution fails to prevent the Government from looting the people then it needs to be changed as it has been changed a hundred times for the benefit of the Looting politicians, surely it can be amended to bring in the provision to punish these corrupt politicians / Bureaucrats by providing for compulsory quarterly Narco Analysis and Lie detector tests to find out about the corruption done by them.

Till today no qualification for Legislators and Parliamentarians has been laid down. Firstly it should be made mandatory for politicians to retire when they attain the age of sixty five years an age at which even Supreme Court Judges are retired. Secondly they should be subjected to Narco Analysis and Lie detector tests to find out about their Black money before their nominations are accepted. If this is not made mandatory then the Country will go to Dogs.

There may be arguments that these provisions are not in the Constitution and Evidence Act but these can be amended in public interest.

Another warning please please beware of appointing any Senior Advocate of the Supreme Court or the High Courts to any Legislative Assembly /Council seat or Parliament or to any other Constitutional Post they are the most dangerous and harmful people in India please do not ask me for reasons as I have found this out by my lengthy research only. Lately they are being given tickets in large numbers by powerful politicians of all parties, as they are helping them in hiding thir Illdeeds and saving them in the Courts.

Are our Security Forces really efficient or are they over glorified

I just want to make the few points as below:-

1. It took almost 72 Hours for thousands of Police personnel and

dozens of Elite NSG Commandos to tackle the Mumbai terror attacks on 26 November 2008 and there were only about ten Terrorists and in fact in the Taj Hotel there were only two or three terrorists and they held on for 72 hours. Major Unnikrishnan lost his life in the operations.

2. Hundreds of Civilians were killed and injured and Top Police

Officers like Hemant Karkare and his colleagues fell to Terrorist

bullets.

3. In the Kashmir Valley almost every month one hears of

encounters between Army and Terrorists and invariably a Major or Colonel of the Army is killed and many Army men injured and there is merely a solitary Terrorist or two killed in the encounter.

4. Recently there was a terrorist attack in Kabul on the

Intercontinental Hotel and all of the about nine Terrorists were killed, within about six hours and the Civilian casualties , were between ten to less than twenty as per reports Please compare.

Fair Price Shop owners Commission be increased and they

be paid salaries also

1. If the above subject line is true then it would be a very contra productive decision because please understand that the Salaries of Public servants have been increased ten fold during the last ten years but the corruption has gone up hundred fold because the public servants due to their increased wages, get used to a better and in fact elitist lifestyles and start moving in still higher social circles, foreign jaunts etc and thus the hunger for money is ten times more, the Scams which used to be in hundreds of Crores are now in Lakhs of Crores. An I.A.S couple in Madhya Pradesh was found to have three hundred Crores in black money. There are thousands like them who have been not caught. Therefore by paying salaries to the Fair Price Shop owners and increasing their Commission will whet their hunger for easy money even more. Why do you think there is a heavy premium to get Fair Price Shops, is it because the Fair Price Shop owners are so mad as to form a queue for some Loss making project. In U.P a Grain Scam of several Thousand Crores in pilfering of Fair Price Shops Grains to Bangladesh etc is being investigated by C.B.I and the culprits are mostly District Collectors and Fair Price Shop Owners.

Therefore the only way that the Public Distribution System can be used for the benefit of the people is by making the Government run Primary / Elementary Schools of Villages as the basic block of development works in Villages /Towns. The teachers in these Schools ( please do not equate them with teachers of higher education in specialized fields, which are even now underpaid) are paid salaries far in excess of the work they do (you can get better and more laborious teachers at one third the salaries it is the mistaken notion of the Government that if they pamper Government servants by paying more money to them then they will work better and will not be corrupt, in fact the opposite is true the more you pay the more corrupt they will be.). They hardly have four hours of work to do and on top of it they enjoy hundreds of days of vacation.
That all the Fair Price hops should be handed over to the primary/ Elementary Schools, they will neither lack the manpower nor the time to do this Job which is in fact very simple as the Fair Price Owners merely open their Shops for only a day or two to distribute the Ration. The children studying will be able to inform their Parents about the availability date of the Rations. In fact these Primary /Elementary Schools teachers and Staff can be given many more Jobs which are presently being entrusted to the Lekhpals/Patwaris/Talatis (Revenue Inspectors called by different names in various States and it is one of the very few Government Posts, which have been manned , since even the British Times by the most corrupt persons and is almost hundred % corrupt cadre and was corrupt even in British times the failure of all the Government Welfare Schemes is mainly due to this cadre, which works directly under the District Collectors, who are the Mother Hen of Corruption in India).
You can give the Job of Survey of BPL families, Job of keeping track of MANREGA Funds, WIDOW PENSION, Old Age Pension, Handicapped Pension Scheme and even entrust the Election List maintenance etc to these Primary/ Elementary Schools. In short if the Country is to prosper then these Primary /Elementary Government Schools (which are present in millions and almost every where) should be made the basic building Block of development and public service. All they need to do is to work for two hours after School hours and even then they will not have to work for more than eight hours a day.

Please give a careful thought and abolish all the FAIR PRICE SHOPS IN THE PRIVATE SECTOR AND HAND OVER THE PDS SYSTEM TO THE GOVERNMENT RUN PRIMARY/ ELEMENTARY SCHOOLS.

Honorable Secretary Ji:

I am pasting below News Item Dated 4 July 2011 disclosing about certain views of the National Advisory Council as well as about some of the Proposals of the Central Government. I have already in Part-1 of my letter to you explained why the 70 /30 ratio for Private Land Seeking Parties need not at all be Incorporated, In fact the present Unrest about Land Acquisition is only because of the Evil Deeds of the LAND ACQUISITION COLLECTORS all over the Country. Details have been given by me in my detailed Commentary on Land Acquisition Amendment Act on my Blog. The reasons behind the revolt against Land Acquisition may be summarized as below:-

1. That The Land Acquisition Collectors, since many decades have

been declaring a fraction of the actual Market rate as Award to nourish the Mafia Nexus of Land Acquisition Collector/His officials+ some powerful and resourceful Villagers (who finance the Reference cases of Poor Villagers) + Advocates (who in turn settle with the Judges hearing the Reference Cases for Increase in Compensation ).

2. That for Example if the Market rate of any Land is say Rs. 1000/= per square Meters then as a general practice the Land acquisition Collector will declare a belated Award of about Rs 100/= Per square meters. Thereafter the Mafia will come in to operation and Agreements will be got signed from affected Villagers (by the Resourceful Villager + Advocates) whereby the Villager will be made to agree to give about fifty % of the increased Compensation (declared in Reference Cases under Section-18 by the Civil Judges) to this Mafia.

3. That The corruption prevailing in Courts, in Land Acquisition Compensation claims is quite apparent from the Observations made by the Allahabad High Court Bench in their judgment dated-05-03-2004 in the matter of Fiirst Appeal No.981 of 2002 (Agra Development Authority V/s State of U.P) and other connected appeals, the Observations are:-

“These facts disclose the scandalous state of affairs prevailing in the district courts of the U.P. and it is no wonder that the public is disgusted with this state of affairs which smacks of rampant corruption”………………………

“Let the Registrar of this Court place copy of this judgment before the Administrative Committee of the High Court for taking appropriate action against the concerned persons and Judicial officers who appear to be in collusion.” One of the Judges who delivered the Judgment in the above case , M.Katju is now a Supreme Court Judge. Dozens of Civil Judges came under a cloud by this Judgment.

4. That in the past, The Land Acquisition Collectors almost always gave their Awards, treating the Lands of the Landowners, almost always as Agricultural Lands. In reference Cases the Civil Courts treated the Lands near the Cities and within them as having probability of being built upon and so in most of the cases they compared the market rates with small plots sold in the Vicinity for dwellings and started deducting from 25 % to ONE THIRD for Development and balance was allowed as Compensation. To better understand it the following example may be taken: (i)- In a Land Acquisition Case of say 1967, in Kanpur the Award is declared at average rate of about Rs. 2000/= per Bigha (about Rs.1/-per square yard), although the Fair market rate is about Rs. 6000/- per Bigha (the Collector almost always ignored the Sale Deeds of higher value on one pretext or other and secondly the Sale Deeds never Reflected the true status because since decades there is a Black money content of about sixty percent in all Land Transactions and in case of Land Acquisition, all the Land Owners suffer on this Account as this black money Component is never taken in to Account while declaring the award and even after adding 15 % earlier and now 30 % Solatium, the Land Owner was always offered a fraction of the actual Market Value), treating the Land as Agricultural. (ii)- The Farmers file Objections and the Acquisition Mafia comes into play and Reference Cases are Filed under Section-18 and the Civil Judge quotes from some Supreme Court Judgments and treats the Land as good for building purposes and compares the rate with some small plots sold in vicinity say @ Rs. 20/= per square Yards and after deducting one third for Development , allows Rs.12/= per Square yards as Compensation. Often the Case goes to the High Court or Supreme Court and a few Rs. Plus or Minus is done and the matter is finally decided in about twenty years on an average. The Land owner finally gets about Rs.5/- per square yard + interest etc and the Acquisition Mafia makes about Rs.5/- per square yards + interest etc. (iii)—As there were and there are no guidelines in this respect , this has continued for Decades. Initially this was not very harmful because the Land was being sold by the Authorities on very little profit and the Development charges incurred were about Rs.4/= to Rs.6/= per Square yard and the Authority was selling Land at about Rs. 30/=. (iv)—That later on some over zealous Pro Government Judges of the Supreme Court (mainly Justice K. Ramaswamy) started giving Anti Farmer Judgments in all cases (please see details in my Letter dated 23 March 2007 on my Blog) and it so happened that what ever arbitrary action the States or Land Acquisition Collectors took was always Justified by the Higher Courts, with the result that a great amount of unrest set in and the Land Owners were only able to get their Compensation after decades of Acquisition and at that time they were not able to buy even 10 % of the Land, which they lost initially because the Land Prices were increasing at about 25 % compounded rate. In the Sixties wheat was about Rs. 1/= per Kg and Land about Rs.30/=to Rs 100/= per Sq Meters. Now Wheat is about Rs.12/= (increased by twelve times ) and Land is now about 10000/= to Rs. One Lakh Rs. Per Square Meters (increased by 300 to 1000 times depending on locality). (v)---In some cases the Higher Courts (Supreme Court and High Courts) started deducting even 84 % for development charges as there were and are no proper Guidelines and in certain cases when Land for Roads etc was Acquired, no deduction was made by the Supreme Court saying that no Land will be required to be left for Roads /Parks etc. (vi)—Presently the External Development charges are about Rs.2000/= per Square meters and Land is being sold by the Authorities at Lakhs of rupees a square meters as heavy profiteering is going on. In the recently struck down by the Supreme Court case of Land Acquisition, The Greater NOIDA Authority awarded Compensation of About Rs. 1200/= per square meters together with all the other statutory dues as per the L.A Act. The Authority sold the Land in Bulk to Builders at Rs. 10,000/= per Square meters. Now providing for deduction of 50% of Land for Roads and Parks, the Cost price to Authority for saleable 50 % area came to about 2400/= per Square meters and by adding Rs.2000/= per square meters for External Development charges, they ought not have sold the Land at more than Rs. 5000/= per square meters and to add salt to the wounds, the Authority is charging the External Development charges from the Builders ,who are taking it from Consumers. So the Authority is engaged in heavy profiteering and at the same time they are not giving the breakup of cost/ selling price to any body, Seeing the Compensation Awarded by them to Land Owners, they had no justification to sell the Bulk Land at more than 3000/= Per square meters as they sell Commercial Land at four times the Residential Rates. In NOIDA , they are selling Land at Lakhs of Rupees a square meters.

5. That in the Land Acquisition Amendment Bill-2009, the Central Government has fixed a better criteria for fixing the Market Rate and for this purpose, they have inserted SECTION-11B but even after this the Controversy will remain because the Collectors declare two types of Circle Rates, one for Agricultural Lands in Rs. Per Hectares/Acres, and one for Residential/ Commercial /Industrial Plots in Rs per Square meters. The difference is huge for example in Gurgaon, the Circle Rate for Agricultural Land is about say Rs. 1 Crore/Acre (i.e. Rs. 2500/=00 per Square meters) while the Residential Circle Rate is about Rs. 15000/= per square Meters, while the actual Market rate as Agricultural Land is about Rs. 4 Crore per Acre and Rate of developed Plots in some areas as high as Rs. 1 Lakh per sq meters and on an average about Rs. 25,000/= per square meters even in unauthorized colonies. Therefore whether the Land owner is to be given Compensation of Rs. 1 crores per Acre at Agricultural rates or Rs. 15000/= per square meters at Residential Rates has not been explained in the Land Acquisition Amendment Bill-2009 and this will remain the main issue of contest and there will be no end to Compensation Litigation.

6. That to avoid this I had made detailed Suggestions in my letter dated 23^rd March-2007 but they have not been heeded. No guidelines in this respect are there as to what rate to apply and where and while comparing the price with market rate of small Plots what is to be deducted for development charges (presently generally 25 % to one third is deducted and in some cases even 84 % has been deducted without any reasonable cause).

7. That about 80 years back the Bombay High Court said that while comparing the rate of Large Plot of Land with that of a small Plot of Land , the Wholesale Rate should be about 40 % to the retail rate , this Judgment was followed by the Supreme Court in only one or two cases but this is a very reasonable calculation. Say in the case of Gurgaon, in Areas where the Retail rate of Developed Plots is 25000/= per square meters the Rate of Rs. 10000/= NETT is Needed to be paid to the Land Owner , which comes to Rs 4 Crore per Acre, which is the actual market Rate of agricultural Land in Gurgaon as against the Circle Rate of Rs One Crore/Acre. You may make inquiries about this and you will be amazed to find it to be true. Therefore clear guidelines are needed in the Land Acquisition Amendment Bill 2009 specially in proposed Section-11- B if farmers unrest/ revolt and consequent litigation is to be avoided

8. That secondly there are no transparent guidelines for fixing of Circle Rates, in Delhi & Gurgaon & NOIDA, where lots of black money is in play the Circle Rates are about 25 % of actual Market Rate while in Cities like Kanpur, where the State Government in its greed for Stamp duty collection has in most outlying areas fixed the Circle Rates at thrice the actual rates with regard to Residential/ Commercial Circle Rates . Therefore this aspect of arbitrary fixation needs to be addressed if Proposed Section-11 B(1) (i) is to be meaningful. Proposed Section 11-B (1) (ii) & (iii) are meaningless till such time that the black money content of Land deals is not eliminated and for this purpose it should be mandatory for the Collector/ Income Tax Department (which has now by Section-50 C of their Act started valuing properties at the minimum rate of Circle Rate) to acquire randomly about 2 to 3 % of properties registered in the Registrar’s Office by paying ten to fifteen percent over and above the purchase cost. (for this purpose a independent Committee will have to keep an eye on the actual market rates and recommend Acquisition of undervalued properties)

9. Whatever may be the provisions of Law laid down,it is certain that the Land Acquisition Collector will never follow them (as per the past record) therefore unless Criminal penalty is imposed on the Land Acquisition Collector, for neglecting to follow the provisions of law, the problem will not end .The present Country wide Unrest against Land Acquisition is mainly because of the malafide and mischievous actions of the Land Acquisition Collectors. That therefore there should be a proviso to Section-11-B to the effect “that if the Land Acquisition Collector omits to take in to consideration fully, the factors provided for by Sections 11-B (1) (i)(ii) (iii) or 11B (2) (i)(ii)(iii), then he shall be held personally responsible and will be punished with imprisonment of three years as well as with fine”.

10. That the Proposed Section-11-B (3) is unconstitutional as it does not matter to the Land Owner as to which Agency is taking his Land and to which Use it will be put. There can be no discrimination on this account in matters of Compensation if this Section is not deleted then it will give rise to millions of litigations. A Judgment or two in this respect of the Supreme Court were given on account of over zealousness to favor the Government and are in fact wrong.

11. That However there may be cases of States, where the Land Owners get only restricted Rights of User of their Agricultural Lands and can not put it to any other Use but in case of Uttar Pradesh the Bhumidhar (Landholder) with transferable Right can under Section-142, of the U.P. Zamindari Abolition & Land reforms Act-1950, use his Land for any purpose including Industry, Commercial, residential and he does not even need the permission of any body under the U.P. Zamindari Abolition & Land reforms Act-1950 for this purpose. The Land of the Land Holder is his livelihood and he can earn his livelihood by his traditional / any other Lawful means through his Land. Therefore a detailed examination on this aspect is needed.

12. That if the true Market Rate is offered to the Land Owner at time of the Section-4 Notification itself and the Circle Rate is reasonable and reflects the actual Market Rate then majority of Land Owners will accept it as I have submitted in my detailed Suggestions dated 23^rd March-2007.

13. That proposed Section 11 C , though not illegal will prove to be useless.

14. That no Proposal is there in the Land Acquisition Amendment Bill-2009 to stop the Illegal practice of Collectors, who manipulate as well as sometimes fabricate records to escape from the LIMITATION PROVISIONS between Section-4 Notification & Section-6 Declaration and Section-6 Declaration and Section-11 Award. To stretch this time limit they insert notices in Newspapers as late as two to three months (and in certain cases even years) and even then if they fail to make the declaration of section-6/ award under Section 11, they fabricate public notice and just type a Notice and show that it was displayed on notice Board in Panchayat or at prominent places. I had given detailed suggestions in the Letter dated 23^rd March-2007, which have not been heeded. In fact the time period between first and last Publication should not be more than 15 days and Criminal Penalty should be levied on the Land acquisition Collector and he should be punished by two years imprisonment on the breach of this period or in the alternative, the First of the date of Publication in the gazette/ Newspaper/ Public Places should be the relevant date for the purpose of date of section-4 Notification /Date of Section-6 declaration as the case may be.

15. 15. That the Amendments proposed in Section -12 are insufficient, the Land acquisition Collectors have been on a regular basis making back dated awards and filing them to avoid Section-11A limitation. It should be made mandatory for the Collector to publish a summary of his Award in the Official Gazette. He should further be directed to publish a public notice of the Award having been declared within three days of declaring the Award and the date of the earlier Publication of the two should be taken as the date of Award. I have given detailed suggestions in this regard in my Letter dated 23^rd March-2007.

16. 16. That the News item dated 04 July 2011 says that the Central Government is thinking of making Section-6 Declaration as relevant date for purpose of Market Value. This proposal is outright foolish as after publication of the Section- 4 Notification, the Act bars the sale and purchase of Land in the Area so after this date , there is no way that the Market value can be ascertained for Section-6 Declaration date. About fifty sixty seventy years back when there was no limitation between Section-4 to Section-6 and between Section-6 to Section-11, the Section -6 date was taken as there used to be gap of decades between the Section-4 & 6 and the only purpose of section-4 by Improvement Trusts was to stop building activities so that the purpose of Acquisition was not thwarted so it was thought fit to take Section-6 date as the relevant date. In the present case there is a limitation of one year between Section-4 and section-6 and 12 % Additional Compensation under Section-23 -(1-A) is allowed over market rate till date of Award which is needed to be changed to 15 % per annum compounded quarterly. So the Section-23-(1-A) needs to be amended accordingly as this is the minimum rate at which the Land prices are increasing.

That the Proposed Amendment to Section-23-(2) of the Act, increasing the amount of Solatium from 30 % to 60 % is not needed and in fact as suggested by me in letter dated 23^rd March-2007, it can be even reduced to 15 %. The only need is that correct Circle Rate, Correct market rate is ascertained and guidelines for comparing the Market rate of larger agricultural Area with respect to rate of small developed plot at 40 % of the small Plots rate is laid down. However the Government may retain the Sixty percent Solatium proposal with a rider that this sixty percent will be given only if the Landowner accepts the Compensation at Agricultural Market value and undertakes not to contest the Award by relying upon any sale of Land of less than one Acre for Non Agricultural purposes.

1 18. That proposal of Part-11A & Part-11 B of the Land Acquisition Amendment Bill 2009 as passed by the Lok Sabha are Useless as poor Farmers can not be asked to go to the state Headquarters of the State Authority as it is they are caught up in the web of the Land acquisition Mafia and the present Proposals are not going to decrease the Litigation. If the Government thinks that just by incorporating provisions of market value assessment on account of the Circle Rate also and increasing the Solatium to sixty percent then the Government is grossly mistaken as the contagious issue of agricultural Circle Rate vis a vis the residential Circle Rate has not been resolved in the proposed Amendment So the Authorities under Part-11A & Part-11 B of the Bill have to be DISTRICT LEVEL AUTHORITIES ONLY so that the Farmer can easily approach them.

The major defects in the Land Acquisition Amendment Bill, which was passed by the Lok Sabha and is again to be Introduced afresh in the Parliament are as follows:-

1. In Proposed Clause 5. of the Bill, which seeks to amend section-3 of the Parent Act,(b)(iv), please instead of “tenancy rights”, “agricultural tenancy rights” should be substituted otherwise all tenants under the Rent control Acts will come within its purview.

2. Proposed definition (f) (iii) is an evil clause it is the very clause which will give rise to the arbitrary Acquisitions, like the one recently struck down by the Honorable Supreme Court in Greater NOIDA matter. Instead of the provision for Acquisition of the thirty percent Land for private persons, the only sane procedure will be to ask them to acquire 100 % of the needed Land. However it may not be possible for them to get a Contiguous parcel of Land as all the Land Owners may not sell to them. So to ensure that they get a Contiguous parcel of Land, the State Governments can go in for CONSOLIDATION OPERATIONS as mentioned by me in Section-4-C-(3) from my earlier letter dated 23-March-2007 to the Prime Minister as extracted below:- 4-C (3):-Because till the acquired land is converted to other purposes, its status remains as agricultural Land for all practical and Legal purposes as such instead of acquiring the Lands to exchange them with unwilling Landowners, the State can go in for consolidation operations under the Consolidation of Land holdings Acts and thus the consolidated Land at one place can be easily obtained to meet the public purpose and there would be no need to acquire any land to give in exchange to the unwilling landowners.

3. I am sure that only by following of this procedure as suggested by me 80 % of the Land Acquisition challenges by the farmers can be prevented. Those Landowners who are forced to shift due to the Consolidation operations may be compensated by 10 % of value of Land.

4. To better explain it take an example where a private party wants say 100 hectares of Land in some Area. He should try to buy all the 100 Hectares of Land and in fact a little more. For this purpose he should negotiate with and Owners of twice the required Area i.e. with and Owners of 200 hectares. It is almost certain that those Land Owners, who are not having their Land on the Main Roads and their Land is not on the front will readily sell their Land if a good price is offered to them. Once the private party is able to get the required 100 Hectares or a little more, the State Government can start Consolidation of Land Operations in the Area and give a contiguous parcel of Land to the private party, with entrance from the Road and during the Consolidation Operation, those Land Owners, having frontage on good roads can be accommodated on alternately (by Consolidation Operations) made Roads. So that they have the least grievance. Here I would like to point out that in Uttar Pradesh, under the U.P. Consolidation of Land Holdings Act-1953 , the State Government can go in for Consolidation Operations after every ten years and if need be at any time. Therefore provision for this can be made in the Land Acquisition Amendment Bill.

1. It is high time the Government lowered the age limit for giving protection to the juvenile criminals.

2. In this age of unobstructed internet and TV obscenity, more and more so called juveniles are taking to heinous crimes. Recently two boys about fourteen years of age are accused of blinding a teenaged Girl in Kannauj in Uttar Pradesh by stabbing in her eyes, when they failed to rape her.

3. There are being reported hundreds of cases of similar heinous crimes by boys above twelve years of age.

4. Terrorists are increasingly making use of juveniles in terrorist attacks and as carriers for drugs and weapons knowing fully well that even if they are caught, they can escape serious punishment being juveniles.

5. If the Government does not wake up, soon , you will find that criminals will make use of Juveniles as shooters and hit men.

1. It seems that Baba Ramdev has lately gone off track, he is saying that the Prime Minister should be kept out of the jurisdiction of the Lok Pal Bill. Forgetting that the P.M is not God and in fact all the Prime Ministers hold charge of Dozens of Ministries. If the P.M is kept out off Lokpal Jurisdiction then all the corruption in the Ministries under him will never be brought to light.

There is no doubt that the recent agitation by Anna Hazare was stage managed by the Congress to counter Baba Ram Dev’s agitation by which, Sonia Gandhi was feeling very uneasy because his agitation was particularly targeting her Ill gotten wealth. The entire drama of Anna Hazare agitation was timed between the World Cup and IPL Season and his demands were met by Congress before he could even loose a little of his paunch.

3. No wonder now Baba Ram Dev is getting back at Anna Hazare but he is raising a stupid demand. Recently one very prominent associate of Baba Ram Dev passed away. People say that he was the actual Brains behind the Baba’s crusade. By the mutterings of Baba Ramdev lately, it seems that this is a fact and the present lot of his Advisers lack the needed I.Q.

We need to look at the facts, use common sense and everything becomes crystal clear. For example, to prove that Osama bin Laden was killed at the compound in Abbottabad, the easiest way is to take the DNA test of the blood on the floor of the compound.
What we all know
August 2010: Pakistan shares with US some details about the compound in Abbottabad. US gathers intelligence that the compound is occupied by Osama’s children.

Jan 27: Raymond Davis, the CIA Station Chief in Pakistan gets an audio file and some pictures of Pak military installations at Tarbela from an informer in Lahore. On the way back he is pursued by two ISI contractors. He realizes that he is being followed and shots both followers in the back. He is arrested by Pakistani police.

March 16: Raymond Davis is released and he shares the information he had gathered with the CIA.

March 17: General Kayani starts criticizing drone attacks in public statements
First Week of April: News started circling that General Petraeus is being transferred to CIA.

April 5: Obama Administration submits a report to the Congress that Pakistan government has no clear strategy to triumph over militants. This is followed by a concerted international media campaign which puts enormous pressure on Pakistani Military and ISI.

April 7: Bruce Riedel, former CIA officer and White House advisor writes a report arguing that Pakistan’s nuclear weapons are not only a deterrent to India but also to USA.

April 8: General Kayani meets with Centcom Chief Gen James Mattis.

April 18: On Pakistan’s Geo TV, Adm. Michael Mullen said Pakistan’s Inter-Services Intelligence “has a longstanding relationship with the Haqqani Network. That doesn’t mean everybody in the ISI, but it’s there.”

April 20: Adm. Mike Mullen meets with Chairman of the Joint Chiefs of Staff Committee General Khalid Shameem Wynne and General Kayani.

April 22: News appears that Pakistan has taken back Shamsi Airbase back from CIA, US forces.

April 26: Washington critically attacks Pakistan Army’s counter-terrorism efforts.

April 26: General Petraeus met with General Kayani.

April 26: Meeting of the Joint Chiefs of Staff Committee (JCSC) is held at Rawalpindi, one week ahead of schedule at the Joint Staff Headquarters

April 27: Wall Street Journal reports that Pakistan is trying to wean Afghanistan away from the United States and draw it into China’s orbit.

April 28: Obama signs General Petraeus’ transfer to CIA.

April 29: Obama signs the orders to attack the Abbottabad compounds.

April 30: General Kayani gave a veiled threat in his Youm-e-Shuhada address: “Pakistan is a peace-loving country and wants friendly relations with other countries and our every step should move towards prosperity of the people. But we will not compromise our dignity and honour for it”.

May 1: Four US choppers flew from Afghaistan. Reaching Abbottabad they attacked a secure compound which housed some important Al Qaeda members. A gun battle soon ensued. Within minutes a Pakistani military helicopters flew from Tarbela, reaching the compound in Abbottabad few minutes later. In the meanwhile US forces had torched one of their own choppers. The four choppers (three US and one Pak) took off from the compound and flew to Afghanistan. Incidentally, this time none of them followed a low altitude flight. They were quite visible on Pakistani radars.

What we all should know

In August 2010 after Pakistani authorities shared intelligence with US about the compound in Abbottabad. US after its own intelligence gathering ascertains that the compound is occupied by Osama’s children. Compound surveillance continues through the next year in anticipation of capturing Osama bin Laden. In January 2011 the young CIA contractor who is give the charge of Pakistan Station Chief works “extra hard” to gather clandestine information related to ISI and Al Qaeda relationship. The contractor, now infamous as Raymond Davis the “American Rambo” receives a call from one of his assets, early morning on January 27 about a high value target. But the asset refuses to lay out details on phone or to leave the Lahore city, where he had gone underground. Raymond Davis hires a rent a car and drives to Lahore, while his security detail follows him in a bullet proof Land Cruiser. Raymond Davis is able to loose his Islamabad’s ISI “detail” by leaving in unmarked rent a car. The ISI agents falling for his trap follow the embassy’s Land Cruiser. Raymond Davis arrives at Lahore one hour earlier than his detail and meets with the asset. The asset gives him some pictures of an intelligence building at Tarbela and recording of a phone call. Listening the phone call Raymond Davis realizes the gold mine he had struck and immediately calls his security detail which had also reached Lahore, knowing if ISI reaches him first, he would not leave Lahore alive.

Next hour when the security car catches up with Raymond Davis, the ISI bosses realizes that Raymond Davis had give them a slip earlier in the morning and in the couple of hours he had in Lahore, he might have got some important information. Resultantly, they put two contractors on his tail. Raymond Davis seeing a tail fears the worse and shoots them both in the back, at a traffic stop, without logically realizing that there was no way ISI could have know what he was holding. His security detail which was close behind rushed to his “rescue” however, by the police had chased and arrested him, while the security Land Cruiser running over pedestrians escapes towards US embassy compound in Islamabad.

ISI officers quickly reach the scene and confiscating the memory sticks realize Raymond Davis has unearthed a deep secret which even their immediate bosses didn’t know about. The sensitivity of information rattles the entire echelons of the ISI and even its own officers are sent under house arrest while the relevant cell steps forward. At that time even some of the top intelligence officers of the secretive ISI outside the relevant cell did not know that Osama bin Laden had died and his body was kept frozen at Tarbela. Young Raymond Davis had unearthed the biggest secret of the century, somehow. But now the Pandora’s Box had been opened. Pak top brass knew it had only a few days or weeks at best to capitalize Raymond Davis’ arrest before US get the intel.

In the next six weeks Pakistan plugs all leaks related to Osama’s death and makes sure that maximum gains are made for Raymond’s release. However, when Raymod Davis is released on March 16, his debriefing results in a tsunami of US policy, personal agendas and fuelling of political rivalries. Everyone in the US chain of command now wanted to use the information to further personal goals from General Petreaus to President Obama.

On March 17, knowing that Pakistan had lost its trunk card General Pervaiz Kayani releases a press statement in which he critically criticize drone attacks, first from him. From then on Pak Military raised its stance against drone attacks, fearing that US now might target its nuclear assets. While in USA politics was at its full swing. General Petreaus wanted to get the buckle for Osama bin Laden’s death on his belt for his future political ambitions, while President Obama wanted the credit to help is sliding popularity.

While the tussle continued, the other issue still pending was how to confirm Osama’s death. In the next one month, nearly every week a top US official visited Pakistan, everyone meeting with General Kayani trying to convince him to hand over Osama’s body. While the stance from Pakistan remained, “Osama, Who?” It was a first in the history that so many US top officials had visited and met with a military chief of a foreign country in such a short time. Seeing nothing getting through the top military brass of Pakistan, US started a political and media campaign on the sides to put extra pressure on Pak Military.

Politics within Obama Administration was also at its full swing. Petraeus was pulling all the strings to take the credit, while trying to lay out a plan to get Osama bin Laden’s body out of Pakistan. President Obama on the other hand in one smooth move decided to “promote” Petraeus to the head of the CIA. The news got out in the first week of April that Petraeus was being transferred to the CIA. While at the main front, Obama continued to pressurize General Kayani and General Pasha and one April 5, Obama Administration submitted a report to the Congress that Pakistan government had no clear strategy to triumph over militants. Alongside the report the media campaign against Pak Military and the ISI continued.

The second week of April began with a bang for top Pak Military brass. On April 7, Bruce Riedel, former CIA officer and White House advisor wrote a report arguing that Pakistan’s nuclear weapons are not only a deterrent to India but also to USA. The obvious had now become clear that Obama Administration has indirectly sent a clear threat to Pakistan’s nuclear assets. The timing of the report was perfect with Centcom Chief Gen James Mattis meeting with General Kayani next day. In the meeting General Mattis asked about Pakistan’s cooperation in capturing Osama bin Laden. This was ironically one of typical Hollywood thriller scene. Pakistan knew that US knew that Pakistan knows that US knows that Osama is dead. But Pakistan continued the naive game of “Osama Who?” while US continued to play the game that “Osama must be captured”. General Mattis leaves with veiled threats and stresses that Pakistan must do more to against the Al Qaeda and Taliban, or indirectly saying that Osama bin Laden must be handed over.

For the ten days US waits and sees how Pakistan responds to the threats, but Pakistan acts by burying its head in the sand – see no evil, hear no evil. Obama Administration ups the ante and on April 18 on Pakistan’s Geo TV, Adm. Michael Mullen said Pakistan’s Inter-Services Intelligence “has a longstanding relationship with the Haqqani Network. That doesn’t mean everybody in the ISI, but it’s there.” Again, international media had its field day against Pakistan’s ISI and its links with Taliban and the ISI. After putting pressure on General Kayani, Adm. Mike Mullen meets with Chairman of the Joint Chiefs of Staff Committee General Khalid Shameem Wynne and General Kayani on April 20. Admiral Mullen again demands indirectly that Pakistan needs to help USA in locating Osama bin Laden. Pakistan’s response was again, “Osama, Who?” Admiral Mullen however, left with another threat that if they came to know about Osama bin Laden’s location they would go ahead and take unilateral action. This is the same message which President Obama repeated in his announcement of Osama bin Laden’s death, when he said, “We will take actions in Pakistan, if we knew where he was.”

In response to continued threats from USA Pakistan starts taking back its air bases from US in an attempt to avoid launching of any operation from its own soil. As a result on April 22 the news appears that Pakistan had taken back Shamsi Airbase back from CIA, US forces. While Obama Administration was pilling pressure on Pakistan, General Petraeus visited Pakistan on April 26 and met with General Kayani openly asking him to hand over Osama bin Laden, otherwise get ready to face the consequences. Same day Washington also critically attacked Pakistan Army’s counter-terrorism efforts. General Petraeus left with a clear message that unless Pakistan hands over Osama, US forces would be forces to take action over Pakistani soil. Pakistani Military knowing that US knew that Osama bin Laden was dead couldn’t understand Obama Administration’s continued stance on capturing Osama bin Laden. General Petraeus left with the ultimatum that either Pakistan handed over Osama or US would get him.

Same day meeting of the Joint Chiefs of Staff Committee (JCSC) is held at Rawalpindi, one week ahead of schedule at the Joint Staff Headquarters. The top brass discusses the Osama issue and decision is reached to work out the Obama’s strategy leading to continuous threats for capturing Osama bin Laden alive, even after knowing that he was dead. While in Pakistan intelligence community starts using all of its sources to reach to the bottom of US’ demand of capturing Osama bin Laden. On April 28 President Obama signs General Petraeus’ transfer to CIA and next day signs the orders to attack the Abbottabad compounds. Thus Osama bin Laden’s credit is assured to President Obama.
On 29 April after President Obama signed the orders to “bring back” Osama bin Laden, Pakistani security agencies get a report that another order had been signed which had authorized US forces to neutralize Pakistan’s nuclear assets, if needed. The report was nothing short of seeing a death angel for the top Pak Military brass.

Seeing the imminent threat, General Kayani tried his last shot when on 30 April 2011 he clearly stated in his Youm-e-Shuhada address: “Pakistan is a peace-loving country and wants friendly relations with other countries and our every step should move towards prosperity of the people. But we will not compromise our dignity and honour for it”. However, it didn’t stop what was about to come 24 hours later.

As night fell on Sunday, 1 May four choppers from a US Afghan base at a low altitude towards its destination in Abbottabad, to the same compound where Osama’s children were in the hiding. Without any detection courtesy of their latest stealth technology and Pakistan’s outdated technology the choppers continued over the Pakistani territory. Ironically, ten years ago a Pak Air force air commodore had raised concern about the outdated radar technology citing that US or worse India could fly helicopters into the country and take out nuclear installations and in reply he was shown the boot while no upgrades to the systems were made.

Anyway, the four choppers made it to the compound in Abbottabad. It is then that Pak Army was notified that they have a choice. Either face an entire barrage of US choppers attacking Pak nuclear assets or hand over Osama’s body. In the meanwhile the small gun battle at the Abbottabad compound continued and to give the drama some authenticity the US forces torched one of their own choppers. Pressed for time a Pakistani helicopter flew from Tarbela carrying dead body of Osama bin Laden which was stored in a cold storage there. While at Abbottabad Pak Army soldiers encircle the entire area around the compound within five minutes of the start of fire fight. The fire fight continued for 35 more minutes, waiting for the Pakistani helicopter. Once the Pakistani helicopter reached the compound the three US choppers and the Pakistani helicopter flew towards the Afghan border, this time without the need to fly below the radar detection altitude.

Next day, the world woke up to the news that Osama bin Laden was dead and President Obama had delivered wheat President Bush and Dick Cheney couldn’t. But the Pak Military brass did not wake up, because they never slept the night before. Last night they had woken to the realization that US could fly under the radar and take out Pakistan’s nuclear assets. The problem here is that US has the complete inventory of Pakistan’s nuclear assets along with exact locations. It would be a matter of minutes in a country wide operation to dismantle Pakistan’s nuclear assets.

1. The OIL COMPANIES(READ CENTRAL GOVERNMENT) have increased the price of petrol by about Rs. 5/= per liters last night.

2. Mamta Banerjee will take oath on 18^th of May-2011.

3. Immediately after it or shortly before she will raise a hue and cry about the petrol price hike and express her anger about this move of the Central Government saying it is anti people.

4. Shortly thereafter the Central Government will announce a roll back by about Rs 2/= per Liter by announcing some rebate in the Central taxes(which comprises of about sixty percent of the Retail price of Petroleum products).

5. Thereafter Mamta Banerjee will further announce a rebate in State Taxes on Petrol.

6. The Am Aadmi will be fooled once again and will be happy, her electorate will rejoice.

7. No Anna Hazare will sit on a fast to tell the Aam Aadmi that the Government is almost always fooling the Aam Aadmi saying that International prices have increased so the domestic increase is justified, while the fact of the matter is that the Government can bring down the prices of Petroleum products by fifty percent by putting them in low tax bracket like other Raw material like Steel etc.

No Nation, which does not, ensure, Justice to its Citizens can ever Survive.

When a few Railway accidents happen, there is a hue & cry & the Resignation of the Railway Minister is called for:

When a few riots take place, the resignations of the C.M, P.M, Home Minister are demanded & in the past a few Politicians did resign taking moral responsibility for the failure although they themselves were not rioting.

After the China War debacle, the Defense Minister went although he was not on the front , fighting.

There is total failure of the justice System in the Country, with millions of cases pending & millions of uprooted Farmers are not able to get their Land Acquisition Compensation as their cases have been pending for decades at various levels.

Millions have died waiting for justice and yet their cases are pending and their dues gobbled up by the respondents, with the Government itself gobbling up billions of rupees being the biggest litigant.

Still many millions, victims of heinous crimes have died, their souls waiting, for punishment of those who killed or maimed them. The President of India, K R Narayanan on 28-01-2000, while speaking on the occasion of the Golden Jubilee of the Supreme Court of India said “That even now Justice is not available to the poor….That is why it is said that Courts are Casinos, where a lot depends on how you throw your dice…..If the Citizens do not get fair & affordable justice then … they may instead of following the rule of law, take the law in to their own hands”.

At various forums, the Chief Justices of India as well as other Hon’ble Judges have voiced their concern saying that the Government is not appointing the required number of Judges and is also not giving the required Infrastructure. It is true that at least ten times the present strength is required. In Pakistan having just about 15 % of population as compared to India , there are about nineteen serving Supreme Court Judges while our Constitution provides for a maximum strength of about 27 or 28 instead, it ought to have provided for a minimum number rather than for maximum.

The result is that many languages and states of the Country may not even find representation in the Supreme Court. Thus from the beginning it seems the Rulers did not want the Country to have an effective Judiciary. All the essentials of life i.e. Education, Health Services, Land for Housing and Occupations, in Cities have been allowed by the Governments to fall in to the hands of the Mafia and it is not providing Infrastructure for an effective Judiciary.

Out of the above, The Government is the biggest Mafia, controlling Land, specially Urban Land, acquiring it at throw away prices on a large scale & thereafter hoarding it and releasing it in small quantities, slowly, driving up the prices and profiteering, a la- Sukhhi Lala of the Film Mother India who used to hoard the grain and then ask for the Honor of the women who wanted grain to feed their Children.

There has grown an all pervading Sense of Gloom and In-Security amongst the Masses in the Country.

The Senior Officers of the Army are being charged with crimes of selling off petrol during transportation & instead, carrying water in its tankers & dumping in the fuel dump(case reported from Jammu recently) then there was the News of selling off of subsidized Liquor of Army Canteens, in to the open market by Army Generals. There has been embezzlements in purchase of Army Rations, Pulses and meat & underweight Eggs as well. Such a situation is deplorable but how does one expect a well read, sophisticated Army Officer to pay for the professional education (Medical/Engineering/MBA) of his Children which can presently cost about Rs twenty-thirty lakhs per person in India. How can he buy a House for himself which in keeping with his status can cost upwards of several Crores in a good-sized City. We are not paying him that kind of a Salary? Therefore by allowing for large-scale speculation in land as well as surrendering the Education & Health services to the Mafia forces the Governments have destroyed the Institution of the Army as well.

Therefore I am aware that alongside the suffering masses of India, People of the Judiciary are also the Victims of the wrong policies of the Governments and many of the Judges at the lower Court Levels along with the Advocates practicing there are also struggling to meet both ends meet. The same may be the situation with respect to many advocates in the High Courts of a few Northern States and even the Judiciary is not free from this sense of Insecurity.

Other than the resignations en- masse by the Judges of the Supreme Court and the High Courts, there is no other way to force the Government to provide for at least ten times the number of Judges as well as the required Infrastructure. That is the only way by which the Governments will be pressurized to act.

Therefore I appeal to those of you , who, have the financial security of their own and not dependant on the Government for it & who have their Children well settled in life, to resign & force the Government to provide the Required Infrastructure & fix a time limit for disposal of various types of cases so that at least 95 % of the cases in all the High Courts/Supreme Court/Consumer Commissions /Consumer forums are decided after full study of files, in maximum 100 days and at least, 95 % of the cases in the lower Courts are finally decided in maximum 200 days.

Although in the past I have said many uncomplimentary things about the Judiciary but recent happenings have made me think again. As per News Item dated 28^th October-2007, in the presence of the Ex Chief Justice of India Shri V. N. Khare, it was observed that the Rulers want to keep the Judiciary handicapped by not providing the required Infrastructure. In view of the above I have decided to Appeal to your good Conscience. I have further decided to devote the rest of my life to achieve the above Objective & raise my voice & undertake a Nyaya-Yatra, to secure Fast & efficient justice for all in India.

This letter is being sent first to the Chief Justice of India only thereafter it will be sent to other Judges.

1. For the last forty years, there is open Rape going on of the Farmers of NOIDA-Greater NOIDA, whose Agricultural Lands amounting to Lakhs of acres have been acquired.

2. All these Lands have been acquired under the U.P. Industrial Areas Development Act-1976.

3. I have seen hundreds of Advertisements released by NOIDA & GREATER NOIDA AUTHORITY over the past twenty years and ninety Five percent of them are for Residential Plots, Commercial Plots, Malls, Multiplexes and even Farm Houses (two have been allotted to Shanti Bhushan and his Son).

4. There are hardly any Advertisement for Industrial Plots or for Townships of poor Workers.

5. In fact NOIDA & GREATWER NOIDA have become Posh Suburbs of Delhi and I.A.S. Officers, Judges, Politicians and Land Speculators of all kind are falling over themselves to get Plots there.

6. Today as I write this there is News on T.V Channels about ongoing violent clashes between farmers and Police/Administration, the D.M has been shot, two Policemen And some Farmers are also dead.

7. All these years nobody, particularly the ALL KNOWING MEDIA has, raised this point at all as to how the Industrial Act of 1976 (which is having over-riding effect over all other Acts of U.P. and that is why it has been chosen to make a City to House the Elite of U.P. including the I.A.S Officers(after retirement), Politicians near to Delhi) is being used to make posh Residential City for the Rich & powerful. There are hundreds of Acres of Golf Courses, Formula-One Race Tracks and all other paraphernalia to cater to the needs of the Super Rich Elite Category of Citizens.

8. Name one Industrial City in India, where the rich & powerful & the Elite of India would like to settle in the midst of Smoke emitting Chimneys and hustle & bustle of the poor laborers.

9. Actually Farm Land, within Agricultural Ceiling Limits is not merely Land but the very livelihood of the Farmers and Landless Laborers dependant upon it as such it attracts Article -21 of the Constitution i.e. the Right to life as such the States should never have been given any role for their control by the Constitution and instead only the Central Government should have been allowed to legislate with restrictions to Acquire it for rarest of rarest purposes, where there is no alternative. In the present case, most of the Land Acquisition is taking place to cater to the needs of private Players under the Garb of some public purpose. The Yamuna Expressway is nothing but a clever scheme to benefit the Jai Prakash group and present C.M. of U.P. the fact is that there is a wonderful National Highway connecting Delhi with Agra all that was needed was to connect this to NOIDA if not already connected.

10. It is indeed shameful and the I.A.S Officers and Politicians , who are engaged in the Rape of Farmers by Illegally using the Industrial Act-1976 for acquiring the Land of Farmers at a few hundred Rupees a Meter and then selling it at LAKHS of Rupees a meter and turned the Industrial Development Act in to a tool for their Land Speculation activities, should be sentenced to death and shot Publicly and the Judges of the High Court & the Supreme Court, who have been closing their Eyes to this Illegal Application of the Industrial Development Act for acquiring the Land of Farmers should also be sentenced by the Courts to be Lynched from the nearest Pole. As for the MEDIA, they should be ashamed that they have never ever raised this issue.

1. Mr Shanti Bhushan was recently accused of getting two Farm House Plots from U.P. Government in NOIDA at throw away prices.

2. While there may be no illegality in the matter yet the fact remains that he has declared Assets of more than hundred Crores of Rupees and these include many Plots, Flats & House properties.

3. Please refer to my Post on sharmarobby.wordpress.com of 27-07-2006, in which I had mentioned about the Ill effects of hoarding of Land and how Speculation In Land has become the National Sport of India. I had written:-

Speculation in land has become the national Sport of India & Indians, every body including Governments, State Instrumentalities, politicians, Traders, Government officers & officials, Judges & other rich & powerful persons are engaged in buying, hoarding & selling at profit, land all over the country.

5. Now the point is that why such a situation has arisen that the poor people have to encroach upon these lands & live in worst conditions than even Beasts in small hovels. Talking about Kanpur when Jawaharlal Nehru visited Kanpur, soon after independence, in the early Fifties, he used these very words when he visited a few hataas on G.T.road in Kanpur. Since then ten five year plans have gone by & the nett result is that now there are fifty times more such Beast like creatures(poor slum dwellers), living in smaller hovels. The situation is the same in all the cities of the Country.

6. lakhs of poor are being evicted from their skimpy shelters (over Government Lands, from the roads, from the railway lines, from the drains, from the footpath land, from above the sewer nalas, from the patris besides the canals, from Sewerage carrying cement pipes stored near the roads) by these lion hearted men of the Government departments with police help.

Government Instrumentalities are hoarding the acquired lands (acquired on a large scale from hapless farmers even at as low a price as a few nai paise per square meters & the same land after hoarding is being sold at thousands of rupees per square meters) like Sukkhi lala of Mother India (who used to hoard grain & ask for the honor of needy women in return for it)& releasing land in small quantities of schemes of a few acres each thus creating a artificial shortage of land & jacking up the prices every now & then, the release price bears no resemblance to the cost of acquisition & the increase in rates are wholly unjustified. While all the other necessities of life including income of honest Countrymen have seen a jump of about 30 to 50 times over the last fifty years, the price of Land has gone up by about two thousand times, taking it beyond the means of the majority.

9. The high cost of the basics of life is turning everyone in to thief those in the Government who are not on seats of power & thus denied extra income by way of bribes are being forced to resort to other questionable means to supplement their incomes. Such a situation is deplorable but how do you expect a well read, sophisticated Army Officer to to buy a House for himself which in keeping with his status can cost upwards of Rs one Crore in a good-sized City.(actually in delhi mumbai & metros it can cost upwards of five crores) Are you paying that kind of a Salary to him ( More recently there has come to light a ghotala by the Army generals & other officers in Dal/Rations while yet another general is accused of Ghotala in purchase of meat ..) Therefore by allowing for large-scale speculation in land the Government is destroying the Institution of the Army as well.

10. I had made the following Suggestions:-

i. Ceiling Act which was repealed in 1999 has to

be re-enacted(after removing the

discrepancies under the earlier law) if the

Country is to be saved. There should be

a ceiling of 300 to 500 sq meters per family in

the case of plots & 3500 to 4000 Sq feet

in case of Flats & this ceiling should be the

maximum that a family should be allowed

to buy in the entire country & should apply to

all towns above100000 (one lakh) Population.

ii. Owners of all vacant plots in excess of this

limit should be allowed one years time to

sell them after which they should be acquired

at maximum of one twentieth of the declared

price of acquisition by them.

iii. Ban Sale of Agricultural land in the cities &

beyond 10 kilometers of their present boundaries to those whose families did not hold agricultural lands at the time of Agrarian reform Acts. This ban not to apply to qualified builders

iv. Give exemption to qualified builders

including exemption from stamp duty with the

restriction that they will have to complete

their Schemes within 5 years, by which time

all the land/flats built by them as per the

layout plan should be sold & registered

in favor of purchasers.

v. Allow a minimum of 2.00 as F.A.R & in case

of lesser ground coverage an

F.A.R of up to 3.50.Relax Master Plan

Density provisions to more realistic levels.

vi. While providing for a maximum F.A.R,

provide for a minimum F.A.R as well so

that only the needy buy the scarce land. Thus a minimum F.A.R of at least 1.5 should be enforced. Fix property tax rates on this basis. Start charging penal rates of property tax on properties which do not consume this minimum F.A.R within two years of purchase. Provide for compulsory Acquisition of all un-built-upon plots at a maximum of 50 % of the cost of its acquisition by the purchaser if they do not consume the minimum F.A.R. within five years of purchase.

vii. The minimum permissible F.A.R to be compulsorily occupied ,Thus an unoccupied dwelling unit to attract penal rate of property tax as compared to an occupied one.

viii. Immediately by a Central Act/ Constitutional Amendment , the Rent Control Acts in all the States should be revoked or amended to take out all portions above 200 square meters from its application . As it is the political parties/ Politicians are the only beneficiaries of these Rent Acts, they are occupying acres & acres of prime properties in the Cities & paying a negligible sum as rent while Lakhs of owners of these properties have died of starvation. The tenants of portions up to 200 sq meters should (subject to owners willingness) be given an option by way of right to buy their portions at 50% of the market rates, failing which they would have to vacate.

ix. Bring down the Stamp duty to maximum of 2

x. Ensure for provision of minimum 50 square

meter of Housing land to all slum dwellers

free of cost or at rates affordable to them

based on the average earnings of Indians

after excluding the earnings of the higher

earning ten % of the population.

xi. Amend the Indian Registration Act & Indian

Stamp Act & exclude lease/rent deeds up to ten years from imposition of the Stamp duty, this will give sense of security both to the owners & tenants, who will be able to enter in to a contract (presently eleven month contracts are being made to avoid stamp duty which are useless as the time period is impractical) &this will prevent lakhs of litigations.

Xii. Acquire all surplus lands lying idle with

Government departments, Mills & shift the

Government Officers to modest

accommodations & reclaim this land &

redistribute it to the poor free of cost.

xiii. Give these lands on lease, free of cost to Educational Institutes who under take

to impart quality Professional Education at

affordable rates to the Citizens.

xiv. In Cantonments, allot surplus lands to Professional Institutes on lease, free of

cost & reserve 100 % of the seats in these colleges for Children of army men.

xv. Declare all Agricultural lands within 5-20 kilometers of cities (depending on their population) as freely convertible to Residential Commercial uses. In addition to this all Agricultural lands on both sides of major roads within say two kilometers to five kilometers(depending on the width of the Major road/highway)should also be declared as freely convertible& Reasonable Restrictions may be put which are easily affordable Otherwise what will additionally happen is what has already happened i.e. the majority have turned in to thieves by breaking the unaffordable & unreasonable restrictions put on User of Land.

xvi. In keeping with the Socialistic Character of

Indian Constitution, it is imperative that the

following steps are taken at once & needed Law

passed:-

1. Shift the President of India to a more modest accommodation & either sell the real Estate of Rashtrapati Bhavan & use the money to provide Houses to the needy in Delhi or to settle the needy right on its site.

2. Restrict the Ministers of the Union & the States to Bungalows of maximum 2000 Square meters.

3. Restrict the Prime Minister & Chief Ministers of the States to Bungalows of maximum 4000 Square meters.

4. Restrict the Members of Parliament & the Members of Legislative Assemblies to Bungalows of maximum 1000 square meters Or Multistory Flats of Maximum 500 Square meters floor area.

5. Restrict the I.A.S Officers & I.P.S officers to Bungalows of maximum 500 square meters Or Multistory Flats of Maximum 400 Square meters floor area.

6. Restrict the other Central & State Government Officers to Bungalows of maximum 350 square meters Or Multistory Flats of Maximum 300 Square meters floor area.

7. Use the saved lands for benefit of the poor.

11. I hope that Sri Anna Hazare will work

towards this end and will further prevail upon his colleague Sri Shanti Bhushan to dispose off all Landed properties owned by him in keeping with the Socialist character of the Constitution so that none in India is deprived from a Roof over his head.

Steps--

1) Earn Lots of Bribe or lots of Crime Money or plain black money & Send it to a Foreign Tax Haven by Havala and park it there in a secret Account preferably in the name of a company of your friend / relative.

2) A firm/company(called unit) is made in the name of the person in India who wants to convert black money into white for developing software and exporting it and gets it registered at Software Trading Park of India(STPI).

3) The units gets enquiry from abroad from the fictitious company formed by you in Tax Haven Country regarding export of software to that Company .

4) Thereafter, your Indian unit gets confirmed orders from the Client (your Company in Tax Haven) at VERY HIGH PRICES in comparison to the work required to be done for developing software as required by the client.

5) Your Indian unit gets the software developed from open market (but shown on papers as it has been developed

by the unit) and gets it checked and approved by STPI (to whom of course some bribe is paid).

6) After getting vet by STPI the software is uploaded through internet and exported to the Client, your tax Haven Company, who sends you payment converting your Black Money in to white.

7) In case you are unable to send your black money by Havala to a Tax Haven & open a Account there or open a Company there ,there are operators who will provide the Foreign Client Company for you for a small fee and in that case they will collect the cash (Black money) from you in India and the Client sends the payment from abroad. Thus the black money gets converted into business (WHITE) money.

8) This exercise of conversion is carried out in view of the provision of Section 10B of the Income Tax Act,1961 which states that 100% profit of the unit is exempted from tax in case it is a hundred percent export oriented undertaking and produces or manufactures article or computer software.

Contrary to what the Government Spokesmen have been claiming on TV channels, there is nothing in the Constitution of India which prevented private Citizens from proposing a BILL however the Parliament afterwards made the procedure for conduct of its business and then made provision only for Government Bills and Private Members Bill. Even then the Bill only needs to be introduced either by a Minister or a Private Member. There is nothing in the Constitution which says any thing about drafting of the Bill. Therefore the stand of the Government that by allowing privately drafted bill it will mean opening a Pandora’s Box and Unconstitutional is totally Wrong.

Whether Civil Society can Join in Drafting of Jan Lok Pal Bill

1. There is nothing in the Constitution about who will draft the Bill.

2. In the Constitution there are only two types of Bills, Money Bills and other Bills. There is nothing in the Constitution which disallows Private Citizens Bills.

3. Later on, when the Parliament made rules for conduct of Business, they provided for two types of Bills, Government Bills to be introduced and not necessarily drafted by the Minister of Concerned Department and Private Members Bill, to be introduced and not necessarily drafted by the Member of Parliament.

4. That thus the Government has merely to take the Jan Lokpal Bill drafted by the Team of Anna Hazare and after due deliberations, GET IT INTRODUCED BY THE MINISTER OF THE CONCERNED DEPARTMENT AND GET IT PASSED. Or A private Member of Parliament can take it and introduce it in Parliament.

Summary of the Bill

This Bill removes certain statutory restrictions applying to land which makes up the site of the former church of Allhallows Staining, its churchyard, and other adjoining land in the City of London. It would:

· repeal sections 4(2)(b) to (e) of the Allhallows Staining Churchyard Act 1961 to remove certain restrictions placed by the 1961 Act on the churchyard relating to the licensing process when seeking to disturb a grave; accessing a grave in the churchyard; access rights of the incumbent of the united benefices of St Olave Hart Street, Allhallows Staining and St Katherine Coleman; and the erection of buildings on the churchyard

· make provision for the legal use, development or disposal of the land stipulated in the Bill. It would, however, be necessary to obtain permissions from any individuals affected along with the normal planning and listed building consents

· impose detailed procedures to be followed by the company (the Livery Company known as the Clothworkers’ Company - the sponsor of the Bill) when seeking to remove human remains

· make provision for the removal and re-erection of tombstones and memorials. The selection of the new location would be agreed by the relative of the deceased person or their representative

Bills

Bills are prefixed with H.R. when introduced in the House and S. when introduced in the Senate, and they are followed by a number based on the order in which they are introduced. Public bills pertain to matters that affect the general public or classes of citizens, while private bills affect just certain individuals and organizations.

A private bill provides benefits to specified individuals (including corporate bodies). Individuals sometimes request relief through private legislation when administrative or legal remedies are exhausted. Many private bills deal with immigration–granting citizenship or permanent residency. Private bills may also be introduced for individuals who have claims again the government, veterans benefits claims, claims for military decorations, or taxation problems. The title of a private bill usually begins with the phrase, "For the relief of. . . ." If a private bill is passed in identical form by both houses of Congress and is signed by the president, it becomes a private law.

When bills are passed in identical form by both Chambers of Congress and signed by the president (or repassed by Congress over a presidential veto), they become laws.

Joint Resolutions

Joint resolutions are designated H.J. Res. or S.J. Res. and are followed by a number. Like a bill, a joint resolution requires the approval of both Chambers in identical form and the president’s signature to become law. There is no real difference between a joint resolution and a bill. The joint resolution is generally used for continuing or emergency appropriations. Concurrent Resolutions

Concurrent resolutions, which are designated H.Con. Res. or S.Con. Concurrent resolutions are generally used to make or amend rules that apply to both houses. They are also used to express the sentiments of both of the houses. For example, a concurrent resolution is used to set the time of Congress’ adjournment. It may also be used by Congress to convey congratulations to another country on the anniversary of its independence. Another important use of the concurrent resolution is for the annual congressional budget resolution, which sets Congress’ revenue and spending goals for the upcoming fiscal year.

Simple Resolutions

Simple resolutions are designated H.Res. and S.Res., followed by a number. A simple resolution addresses matters entirely within the prerogative of one house, such as revising the standing rules of one Chamber. Simple resolutions are also used to express the sentiments of a single house, such as offering condolences to the family of a deceased member of Congress, or it may give "advice" on foreign policy or other executive business. Simple resolutions do not require the approval of the other house nor the signature of the president, and they do not have the force of law.

The Ayodhya Judgment was delivered by the Allahabad High Court on 30th September-2010 and the following are the undisputed facts:-

1. That till the Ayodhya Judgment, the claims of the Hindus, that the Muslim Invaders had demolished thousands of Hindu ( Including Buddhist ) religious structures and built their places of worship and graveyards and Tombs as well as palaces over the Site were always passed of as imaginary without proof but now it has been established, both by Judicial pronouncements as well as Archeological and Scientific Evidence that Yes the Muslim Invaders did demolish thousands of Religious structures belonging to other Religions.
2. Mr Mulayam Singh Yadav as also the Muslims want that the Courts should only take a cut off date ,in relevance, which suits them i.e. The Courts should not take in to Account the status and ownership of the Site, which existed prior to 1528 the alleged date of demolition of Hindu Religious Place and Construction of Mosque and the Court should not take in to Account the Status after 1949, after Partition, when again the Idols were placed in the Central Dome. What they say is that only the Dates between 1528 to1949 should be the relevant Cut off dates and status of Mosque should be recognized. Now I wish to point out that Religious structures of Hindus and other Religions were destroyed by Muslims by the force of their swords. (Even Christians destroyed the Religious structures of other religions when they had the power of the sword on their side. They took away the Land of the Hindus and gave it away to converted Christians, all over India including Goa and it was only when the brave Hindu Kings like Shivaji, Ranjit Singh, Guru Gobind Singh and others became powerful that the Hindus were able to get back some of their lost properties). What these Invaders and their Successors wish to be legalized by the Courts is that once a foe has been subjugated by force, all his Right to regain his property ( when he gets the power to take it back ) should be lost forever to him. Going by their contention Ram never had the Right to regain Sita, who was abducted by Ravan.
3. That can not be so take the example of Israel, the Jews, the oldest of the lot i.e. Jews ,Christians and Muslims in that order, regained after centuries what was grabbed by other religions from them like Jerusalem and all their other religious places belonging to them and that too after thousands of years, when they gained the power to regain these places.
4. That therefore as far as other mundane property is concerned, if such property is taken forcibly from him , may be in a barbaric Society the original owner loses his Title and Right to regain it immediately after the event and even in Civil Societies he may loose it after a few decades or centuries but as regards the matters of faith, the Right, to, regain the Places of Faith, Lost , to an invader will always remain with the original faithful for eternity.
5. One other noticeable fact after the Ayodhya Judgment was the Contempt and rightly so with which Sri Ravi Shankar Prasad the Advocate of Hindu parties and BJP M.P, treated the Hindu Bashing , Pseudo Secularist Media Bigwigs like Barkha Dutt, Arnav Goswami, Pranoy Roy, Rajdeep Sardesai and Ashtosh , who get their bread and butter from Islamic Sheikhs and the Church and whose sole aim and profession is Hindu Bashing. Hats off to Sri Ravi Shankar Prasad.
6. Please take an oath that in matters of faith do not ,repeat do not rely on the Courts as the Constitution has not provided for the undoing of the wrongs committed by the Invaders. The Supreme Court may undo the High Court Judgment .It will be in the interests of Muslims to do some introspection and ask the Hindus for a small list of other such very important places, sacred to the Hindus ,which were destroyed by the Muslim Invaders ( even their own Historians recorded the plunder of the Hindu Temples and the facts are known to all ) and then offer to restore them to the Hindus if the Archeological evidence supports their claim and it will be in the interest of the Nation that the Hindus keep such a list as short as possible and resolve the matter once and for all.

The News Channels Glorified her by saying that there was a love angle behind her spying Activities. Now why must Love be so degraded, it was nothing but Lust or plain craving for sex and money which was behind her evil deed and this should have been highlighted by the Media.
I have been researching the subject and have reached the conclusion that Ugly Men or women should never be given top posts in bureaucracy as their inferiority Complex forces them to seek publicity at any cost.
I recollect that in Kanpur, there was this I.A. S. officer N.N. Prasad , Vice Chairman of Kanpur Development Authority, a truly ugly man. He was publicity crazy like hell and not a day would pass before he would call the press and give some sort of interview to them highlighting some imaginary gallant deeds he was doing on the post. Millions of Rupees were distributed to the Press-walas through the Care taker of this cash rich but totally corrupt Authority. One leading newspaper magnate of Kanpur printed his interview on 3rd of October, 1999 praising him and the next day this ugly fellow sent a proposal to allot to the Newspaper owners a ten thousand plus square meter Garden Plot on the biggest Cremation Ghat of Kanpur for building a Multiplex Cinema cum Mall and finally allotted it to them.
Similarly One Anita Bhatnagar Jain another I.A.S , while she was Commissioner of Kanpur /Vice Chairperson K.D.A was a ugly midget and like N.N. Prasad she could not bear the thought of a day without seeing her picture in the News papers she also spent lakhs of rupees of K.D.A’s ill gotten do number ka paisa (load on contractors and Touts and officers through the care taker.) on pleasing the Press walas in good humor.
I used to attend some seminars on Environment Issues those days in the Merchant Chamber they were hosted by one Rakesh Jaiswal who ran a N.G.O. Eco friends. Every time she used to be the chief guest and every thing would be serious and quite till she made her entry and along with her appeared a full battery of Press Photographers and Reporters as if they appeared out of her body itself. I remember a Movie “Shogun’s Ninja” in this movie the villain had two ghost like evil creatures who during a fight used to appear from the Shogun’s Arse and kill his opponents. I stopped attending the meetings in disgust.
Therefore my advise to the Government is not to post ugly I.A.S or I.F.S officers to sensitive posts.
Look at it the other way also, Laloo Prasad , Mulayam Singh and many others, who are facing C.B.I probes for ill-gotten wealth now what do they have in common. You will find hundreds of such examples of ugly people on high posts ,they are all publicity crazy and mostly corrupt. What is more they become so only when they hold high posts not if they have a normal status. Remember Advani was also under the Hawala cloud, look at Chandra swami, Shibu Soren, Bangaru Laxman, A Raja Karuna nidhi, Lalit Modi , Hooda, , Narain Dutt Tiwari, Arjun Singh, Badal and the like. Look at Amitabh Bachan, Shahrukh Khan, Amar Singh & Sanjay Dutt, all ugly and always in News and controversies. I may be wrong but I have a strong hunch that I am right.
On the other hand look at Madhav Rao Scindia, Jai Ram Ramesh, Sachin Pilot, Jitin Prasad, Rajiv Gandhi, Rahul , Priyanka, Sonia, Nitish Kumar, all charming people with radiant faces and you will never hear about any such lowly ill deeds attributed to them, with the exception of Tharoor.

Here is what an enlightened gentleman in Rajasthan told me about the origin of the Marwari’s wealth:-
In the barren desert of Rajasthan, where no agriculture was possible,the only thing which grew in abundance was shrubs and dry grass, as a result hundreds of Nomadic families, who owned lakhs of Cattle, Sheep, Camels etc used to roam the country side, including other States to graze them, the entire families/tribes accompanied the herds, which were many miles long (I myself came across never ending rows of sheep, for miles and miles and that too in early seventies) and once or twice a year , they used to return to their villages and when they used to sell or sheer their cattle, they were faced with the predicament of safeguarding the money realized, as they were roaming around most of the year, easy target for bandits.
The local, cunning Marwaris living in small towns used to charge them interest for keeping their money safe and at the same time used the money to lend to Kings and Nawabs in their hard times and later on invested this money in big towns like Calcutta, Madras, Bombay, Kanpur etc etc in money lending and Industrial ventures.
Thus they realized double profit on the money, as safekeeping fee from the owners of the money and on account of interest earned from those to whom they lent it or in the industrial ventures they undertook by that money.
That is what is called Aam ke Aam Guthlion ke daam.
From the abject poverty widespread in Marwar /Rajasthan it seems that many of the actual owners of the money were not paid back and many perished, while roaming, at the hands of Muslim invaders, while the Marwari grew fat, wealthy and successful on the Nomad’s money.

(A)-- With respect to the above it is not clear whether the prophecy was only about Chinese Occupation of thousands of Square miles of India’s Land, which China already occupies or whether it predicts that Entire India will be occupied by China.
(B)-- Surely West Bengal has been already under occupation of the Communists for last thirty years and they the Communists had their allegiance towards China even during the 1962 Indo-China War so does it fulfill the Prophecy or is their still more to come.
( C)-- What is however certain is that the Church, which started the Balkanization of India by converting all the tribes of entire North East –India, will be the main culprit in the event of the Occupation of North East India by the Chinese, which is a certainty in about fifty years and who knows may be they will drive down the beautiful Highways being made under the Golden Quadrilateral Scheme.

Here is what I got to hear from a Veterinary Doctor friend.
During the tenure of Morarji Desai as the P.M of India, In keeping with his policy of prohibition, it was decided to declare at least the Pilgrimage Centers as Liquor Free areas ( Madhya Nishedh Chetras) in U.P. The Birth place of Tulsidas, Rajapur was also chosen to be so declared and the then Minister in charge hailing from Kanpur was to address a function there and declare it as Liquor free Area.
The Excise Commissioner One Mr Lal and few of his cronies started in their Ambassador Car from Allahabad to make arrangements for the Ministers Visit. Their Car broke down and in those days the way to Rajapur was hazardous and even the BDO did not have a Jeep, there were none available on hire also. The Medical Officer posted in the Block & Doctor Sachan the Veterinary Doctor posted there offered to carry four persons including the Commissioner on their Motorcycles to the Rest House in Rajapur.
The Excice Commissioner was carrying a sealed wooden Crate, which could not be carried on the Motorcycle so Doctor Sachan advised that the Crate be opened and the contents carried in the side Dicky of the Motorcycle and partly in hand bags as they could not keep the Crate on the Motorcycle and still carry two passengers. With great reluctance the Excise Commissioner agreed and the crate was opened, it contained dozen or so Bottles of the finest liquor.
The Minister and his Entourage as well as the Commissioner and his party had a hearty Liquor Party with Chicken, mutton and other delicacies in the evening in the Rest house and in the Morning, The Minister paid Rich tributes to Tulsidas ji calling him a great saint and said the place of his birth was a sacred place and in front of the gathered crowd, he declared the Area as Liquor Free Zone (Madhya Nishedh Chetra).

Ever wondered why the fact of ethnic cleansing of Pandits from Kashmir never garnered the media Screens headlines.
Ever wondered why the Godhra carnage & the burnt Kar Sewaks & the Train went out from News channels and print media in a flash while the News about Atrocities committed on muslims in Gujrat refuse to exit the T.V screens.
Most of the English print media was already controlled by the Islamic Oil billions and after the TV media came in to being now it is they who are receiving billions of OIL dollars to show hate stories about so called Hindu fundamentalism. After the Godhra carnage and subsequent Gujrat riots, most of the media heavy weights were paid billions of rupees to espouse the Islamic cause, One Media reporter a she who often reports from the Bunker and another media stalwart one son of a famous India Cricketer are said to have been paid and are being paid crores and crores of Rupees of Oil money by the wealthy Sheikhs.
How the Muslim cause is being espoused by the Judiciary also needs to be kept watch of. Islamic money is now influencing the Judiciary in a big way. Ten Lakh Rupees interim Compensation has been awarded for the fake encounter case of a known criminal. Has the Supreme Court ever passed any order condemning the ethnic cleansing in Kashmir.
Most of the NGO’s headed by Magsaysay or Booker prize winners and other English speaking elite are striding the Courts and Political forums as they get fat on Islamic money routed to them through different channels. Did any of them ever say a word about the Godhra or Azamgarh carnages while they took the Best bakery case till the Supreme Court.

The likes of Tista Sitalwad, Arundhati Roy, Megha Patkar, Sunita Narain, Bunker Girl B.D and our own Mamta Didi, Brinda Karat & her other Commie friends as well as the entire Congress and Samajwadi fraternity get their Throats sore by shouting Anti Hindu Slogans. Were they to dare to go and raise their voices in Kashmir against the Islamic radicals in Kashmir for the Ethnic Cleansing of Hindus, I am sure that most of them would be raped, maimed & killed and their deaths blamed on the Security forces.

1. I had written, earlier, a detailed article on River Pollution, specially about River Ganga to your good self on 22-06-2008. Since then you have declared the Ganga River as a National River and declared the formation of a Ganga Basin Authority. Sir people have applauded your action but I wish to lodge my protest for the same because I feel that it is such irresponsible acts of Politicians, which have been slowly breaking up the Country

I had in my earlier letter clearly mentioned that “The Government of India should immediately make suitable Legislation with reference to the entry at S.No.56 in the Seventh Schedule, Union List of the Constitution & immediately make suitable Legislation with regard to the Ganga & other Inter-State Rivers. Although in the end of that letter, I had also expressed my special anxiety for the Ganga, which action of mine, I myself regret, but you being the head of the family should have tried to treat everyone, every State and its people and the Rivers flowing through them alike.
3. That you have under pressure of various agitations, declared the River Ganga as a National River and also garnered much publicity. Are you waiting for people of other States, also hurt by the pollution of rivers, flowing through their states, to start agitating with respect to other Rivers, take to the Streets, before they can get the same Status for the Rivers, which are their very lifelines. Such actions of Politicians have been breaking up the Nation. Every four or five years, there are agitations saying that such and such part of such and such State is being discriminated against and there is demand for new State and many have been made and they may further, in future, turn in to Countries, who knows?
4. Therefore you should have made similar announcements for all other Inter-State rivers and should not have singled out the Ganga. More on the matter need not be said as it should be understood. Sir I condemn your action of singling out the Ganga for granting National River Status. It should be accorded to all other Rivers and the legislation, you have made under your powers given by the Constitution should be made regarding all the Rivers of all the States. Had you mentioned in your declaration that you would be making similar legislation in the shortest possible time for other Rivers also then your declaration could have been termed as a rational one but in the absence of such a assurance, it ,your declaration, smacks of appeasing a certain section of the electorate, before the recent elections.

For years during my Research on various topics including the Town Planning Laws of India, I have noted that it is on rare occasions possible for the general public of India to get a few orders from the High Courts, which go a long way in addressing the problems of the teeming masses but All such good things come to an end in the Supreme Court of India, which more often than not stays the Order of the High Court arbitrarily then keeps on sitting on the Petition for years, often decades altogether, resulting in denial of the Relief to the general public, which the High Court took pains to provide. I shall be discussing a few cases periodically, Some cases I am detailing below:-

1. The State of U.P was taking very heavy amount as premium for free hold of Nazul Land given on lease earlier while in the case of Free hold of plots given on lease by the Development Authorities and Awas Vikas Parishad, only a fraction was being charged .In a Land mark Judgment,dated-30-03-2006, the Allahabad High Court in Civil Misc Writ Petition No.3341 of 1999 in the matter of Harish Tandon V/s State of U.P, found this to be discriminatory and in violation of Article 14. This Judgment would have benefited Lakhs of holders of Nazul leases.
2. However, as usual, before the general public could reap the benefit of the judgment of the High Court, the Supreme Court, aghast at the relief provided to the general public i.e. the insignificant common man, stayed the order and thereafter it has been sitting on the file for about three years. On top of it had taken 7 years in the Allahabad High Court and before that a considerable time in fighting before the Authorities. Till today, the case is pending and it is such a case in which it is most likely that the private party may have already reaped the benefit of the High Court Judgment and even otherwise may not even file a reply so the Case will meet a slow death in the Supreme Court and thus the benefit given to the common man by the Allahabad High Court has been denied to the public by the arbitrary and Authoritarian stay order of the Supreme court and it is more than possible that it will be denied forever because of the negotiating powers of the State Government. Therefore once the Supreme Court stays an order of the High Court of such a great public importance, it ought to and it should decide the case in maximum six months even if the respondents are served or not after all they do have the brains to decide the case even in absence of the reply or do they lack the brains and have to depend on the replies and arguments of advocates in which case the public will always loose as the State can afford to hire the most expensive Advocates at public cost and that too mostly to serve their egos and no public interest is involved in challenging the orders of the High Court.
4. This article will be continued regarding other cases, where the Public interest benefic Judgments passed by the High Courts have come to an end in the Supreme Court of India and have been pending since ages.

News paper headlines as below:
Railways will post special posse of RPF personnel in trains frequented by Army Jawans, a list of trains for regular posting of the Posse is given then it is further revealed that if ten or more Army-men are found to be traveling in any one coach of any train the Special RPF Posse will be rushed and posted in that bogie.
According to the News report, there were about hundred cases of Molestation of Women passengers, by Army personnel, reported (at-least ten times that number must have gone un reported) at Kanpur Central Station alone during the last year.
The present decision was taken after the incident of two days ago when a Army Jawan, tried to drag a Canadian girl to the toilet, to rape her, he tore off all her clothes, fellow passengers saved her (had the Coach contained more army personnel than there actually were, chances are, that she would have been Gang raped by them and some of the fellow passengers too in all probability. She kept on crying the whole night, complained to the T.T, who sent the GRP escort, who ran away then after about fourteen hours , a few RPF Personnel caught hold of the Culprit and handed him to the G.R.P in Kanpur.
So many accolades are showered on the Army men like they lay down their lives etc etc for the Country but do not forget that there are hundred times more people, willing to be in their shoes, for lesser pay even, it is all because of the huge unemployment problem in the Country that the Army is able to recruit so many Jawans, in Recruitment process alone, hundreds die due to the huge crowd and resultant stampedes etc.
How ever when it comes to the Officers, up to the Major level, there is no parallel to the Indian Army Officers. It seems that the Jawans minus the control of these Officers are just a unruly Mob and that too in a Country, which almost worships them. I have never ever in my life ever seen any citizen showing disrespect to the Army-men. However if ever you are forced by circumstances to board a Railway Compartment, Monopolized by them, prepare yourself for a harrowing experience, you are at best a enemy for them in the coach.

Reminds us again about the most corrupt Country we live in. You see Rahul Gandhi, Manmohan, Priyanka and Sonia waving with radiant smiles on their faces after the Recent Victory. You hear talk of the power given to the youth. You see faces of Jatin Prasad, Jyotiraditya, Priya Dutt then Sharad Pawar’s daughter, Kumari Selja, Naveen Jindal, Sachin pilot , then Karuna Nidhis clan then a few Politicians Concubines etc etc (more of the last lot will come after the Women reservation bill )actually all of them are Billionaires. So are the seniors so effectively you have a Parliament & Ministry populated by at least 95 % Billionaires. Those who have declared five Crores are at least worth a hundred times more every body knows that. Have you noticed any decline in the level of Corruption in the Country? Actually no. In fact it used to be in lakhs previously, now it is in hundreds of crores and mark my word no politician wants to change that.
If things are to change then this younger generation must come clean, say alright our fathers made billions and we are sorry and we are giving back this ill-gotten wealth, back to the Country and keeping say 10 % for ourselves and now we will work to remove Corruption from the Country. No body , none of the so acclaimed younger lot has done that till now.
I recollect in the early eighties, a Rickshaw driving license was made by the Mathura Municipality, in Rajiv Gandhi;s name, complete with his Photo and fathers name etc. Indira was the P.M. Afterwards many heads rolled in the Municipality.
Kerosene shortage was there even then and people had to give an application to the District Supply Officer if they needed Kerosene for some function. There was brisk business of Kerosene Consumer permits in Agra and the general trend was you write the application, asking for two cans (or pipa as it is called in U.P.15 liters each) give some reason, for the need ,give twenty to thirty Rupees per can to the Tout, who used to enclose one ten Rs note with the Application for the Inspector, who used to mechanically just cut the figure “two cans” and write “allowed one can” and thereafter the permit was obtained after paying the other staff. So one person wrote in his application like this “Sir due to too much corruption in the DSO office, I need two cans of Kerosene to set fire to the DSO office.” The inspector mechanically wrote “allowed one Can” and the permit was issued. Next day it was in the headlines “ DSO issues permit to burn his office”. So corrupt is the System.
No body has forgotten how warrants were issued by a Gujrat Court in name of President of India & others.
I recollect that about twenty years back when one had to settle some traffic Challan in the Court, one had to pay about twenty to thirty Rupees to the dealing clerk and he used to pin up one Rs ten or twenty Rs note with each application and go before the Magistrate, Now it is a hundred Rupees note. At that time the Magistrate used to make about Rs two thousand daily without any effort, now it is about ten thousand daily and the process is fully mechanical, you don’t even have to go before the Magistrate.
We live in shameless spineless country.

For years during my Research on various topics including the Town Planning Laws of India, I have noted that it is on rare occasions possible for the general public of India to get a few orders from the High Courts, which go a long way in addressing the problems of the teeming masses but All such good things come to an end in the Supreme Court of India, which more often than not stays the Order of the High Court arbitrarily then keeps on sitting on the Petition for years, often decades altogether, resulting in denial of the Relief to the general public, which the High Court took pains to provide. I shall be discussing a few cases periodically, Some cases I am detailing below:-

1. In a Land mark Judgment,dated-October-14-2004, the Allahabad High Court in Civil Misc Writ Petition No.13560 of 2003, in the matter of Rail Vihar Kalyan Sahkari Awas Samiti Ltd and seven other connected petitions ruled that Once a Housing Society had got the Sale/lease deed executed in its favor, the State Government could not force its members to get individual deeds executed in their names as they themselves were the owners of the Society as such they could not be forced to get registered separately portions allotted to them individually, as they themselves were their owners and there was no need for payment of any further Stamp duty by individual members.
2. However, as usual, before the general public could reap the benefit of the judgment of the High Court, the Supreme Court, aghast at the relief provided to the general public i.e. the insignificant common man, stayed the order and thereafter it has been sitting on the file for five years. After completion of hearing, one of the Judges opted out of the case, strangely requiring rehearing by another Bench. The hearing was completed on 15th of October-2008 and the Supreme Court passed the following order “

Till today, the Judgment has not been pronounced and the State of U.P continues to Extort Crores of Rupees, from the general public Therefore the benefit given to the common man by the Allahabad High Court has been denied to the public by the arbitrary and Authoritarian stay order of the Supreme court and thereafter its reluctance to pass the final order may be because of the negotiating powers of the State Government.

M S Gill Ex Election Commissioner-A National shame

The ex Election Commissioner M S Gill has become a second term Minister. I can not but help in seeing him as a National Shame.
He may believe himself to be a totally honest man but the very fact that he jumped on to the band wagon of a Political party after his retirement was and is shameful.
How can one believe that he was neutral while he was the Election Commissioner? There are certain norms of decency for which no rules are laid in any law but the individuals, who occupy high Constitutional posts are supposed to know about them and follow them.
Mr Gill, by his greed for power, has set a shameful precedent and the likes of Naveen Chawla, already under cloud are sure to follow suit.

For years during my Research on various topics including the Town Planning Laws of India, I have noted that it is on rare occasions possible for the general public of India to get a few orders from the High Courts, which go a long way in addressing the problems of the teeming masses but All such good things come to an end in the Supreme Court of India, which more often than not stays the Order of the High Court arbitrarily then keeps on sitting on the Petition for years, often decades altogether, resulting in denial of the Relief to the general public, which the High Court took pains to provide. I shall be discussing a few cases periodically, Some cases I am detailing below:-

1. After the passage of the Right to Information Act-2005, all public documents, other than those for which specific exemptions have been provided in Section-8 of that Act were to be disclosed. The Public Authorities to cover up their Corruption, have been opposing the RTI applicants on one baseless ground or another resulting in the matters reaching the Courts.
2. Lots of students filed RTI applications seeking certified photocopies of their Answer sheets, the Applications were opposed by Central Board of Secondary Education, Various State Boards and Universities, However in the matter of Pritam Rooj v/s University of Calcutta, the Calcutta High Court single Judge on 28-03-2008 as reported in AIR 2008, Calcutta-118, ruled that the Answer sheets were not exempted and should be disclosed. The matter was taken in Appeal to the Division Bench of the Calcutta High Court, which, on 05-02-2009 in M.A.T No.275 of 2008,University of Calcutta vs Pritam Rooj; Writ Petition No.18189(W) of 2008, Aditya Bandopadyay V/S Central Board of secondary Education and W.P No.208 of 2008;W.P. No.5302(W) of 2008; W.P.No.57423(W) of 2008, W.P.No.5744(W) of 2008, in all of which West Bengal Secondary Education Board was a party, ruled that :- “A few words before we conclude our discussion on the second issue supra. We would not be unjustified in taking judicial notice of the Courts of Writ nowadays being flooded with innumerable cases filed by aggrieved parties - particularly students of schools, colleges, universities and other academic institutions, as also participants of various selection examinations conducted by the appropriate bodies for recruitment to public service alleging wrong, improper or unfair marking and gross negligence in the assessment of their written performances which, according to them, ultimately hamper their academic and career progress substantially. Since marginal difference in marks decides placement of candidates in the merit list, the anxiety of the examinees/candidates can well be appreciated. However, success rate of such petitions is not very high considering the fact that the aggrieved parties often fail to demonstrate before the Court as to how the assessment is defective or arbitrary. Yet, situations are not rare where various Courts have called for production of the answer scripts of aggrieved examinees and detected mistakes, at times glaring, in assessment of such scripts or non-awarding of marks
commensurate with the assessment made. Though the Courts in appropriate cases have passed orders for re-examination and scrutiny which have resulted in the aggrieved party being awarded his dues, it is often seen that the said relief has come at a time when their losses are beyond repair - a valuable year has been lost or an employment opportunity sorely missed in these fiercely competitive times thereby resulting in untold misery and harassment to them. The RTI Act, therefore, in our considered opinion would act as a buffer to such incidents in future and will help aggrieved parties to get their rightfully deserved relief. It also hopefully will act as a warning for errant examiners and assessors to perform their duties more diligently.
Before parting, we rule that the observation of the learned Judge that the proviso at the foot of clause (j) of Section 8(1) is a proviso to sub-section (1) of Section 8 is not the correct exposition of law and while holding it to be obiter dictum, we would respectfully agree with the decision of the Bombay High Court reported in AIR 2007 Bom 121 : Surupsingh Hrya Naik vs. State of Maharashtra in this regard.
The judgment and order under appeal does not call for interference. The orders impugned in the writ petitions filed by the WBBSE also do not call for any interference. The writ appeal of the University and the writ petitions filed by the WBBSE stand dismissed. The connected writ petition being W.P. No. 208 of 2008 filed by the father of the examinee stands allowed. Inspection shall be granted to the concerned examinees within four weeks from date of receipt of a copy of this judgment, if not already granted.The order of the CBSE dated 12.7.2008, impugned in W.P. No.18189 (W) of 2008, is set aside. The writ petition stands allowed within a direction upon the CBSE to grant inspection of the answer scripts to the information seekers/examinees concerned within four weeks from receipt of a copy of this judgment. Prayer made by the examinees for reevaluation of the scripts, however, stands refused. It shall be open to them seek relief in this behalf in appropriate proceedings, if initiated, after they have access to the assessed/examined answer scripts. Photostat copy of this judgment, duly countersigned by the Assistant Court
Officer, shall be retained with the records of W.P. No. 208 of 2008, W.P. No. 5743 (W) of 2008, W.P. No.5744 (W) of 2008, W.P. No.5302 (W) of 2008 and W.P.No.18189 (W) of 2008.
Urgent photostat certified copy of this judgment, if applied for, be
furnished to the applicant within 4 days from date of putting in requisites therefor.

4. The Order of the Supreme Court is so confusing that thousands of RTI applicants/Students will be hit by it, the Boards will refuse the RTI applications and the students will have to go to the High Courts before they can get to see their Answer sheets. The Order of the High Court of Calcutta was so clear that it directed clearly “The writ petition stands allowed within a direction upon the CBSE to grant inspection of the answer scripts to the information seekers/examinees concerned within four weeks from receipt of a copy of this judgment.”
Therefore the Order of the High Court was clearly for the benefit of those Examinees, who had filed RTI Applications for disclosure/provision of Photocopies of their Answer Sheets and the same were pending in the Boards.
Therefore the benefit given to the students by the Calcutta High Court has been denied to the public by the arbitrary and Authoritarian stay order of the Supreme court and because the Respondents in the case are not hit by the case therefore they will not even file the replies in the Petitions so the case may drag on for decades in the Supreme Court and the important Question of Law decided by the High Court, so elaborately will be buried in the waste Paper Basket, that is the Supreme Court of India till the future RTI-applicant students, become grandparents themselves.

I shall be discussing a few cases periodically, Some cases I am detailing below:-
1. In a Land mark Judgment,dated-April-12-2005 the Allahabad High Court in Civil Misc Writ Petition No.54536 of 2004, in the matter of Vivek Srivastava V/S Union of India while considering whether, the Cantonment Board/ Union Of India/ army authorities could build Staff Quarters on a Open piece of Land, owned by them, which was being used for decades as a Polo ground and thus open green area, within the Allahabad Civil Lines Area, passed the Judgment as below:- “In order to implement a disaster management plan it is necessary that open spaces exist in the city. These open pieces of land could be used for various purposes during an emergency. In times of floods, fire, earthquakes etc., open spaces in the city could be used to minimize and curb the human suffering caused by the natural calamities. Disaster management is an integral part of the development activities and cannot be separated from a sustainable development of the city. For a sustainable development of the city, and for a healthy growth of a city, existence of open spaces, green belt is essential. For the aforesaid reasons, it is necessary to maintain open spaces for disaster management plan. Thus, in view of the aforesaid, we are of the view that the land in question known as ''Old Polo Ground' measuring approximately 22.77 acres of land, should not be used for the residential construction for the married accommodation project for the married officers of the Army. The respondents have other large tracts of open land in the Cantonment which could be easily utilized for the construction of 48 dwelling units proposed under MAP on the Old Polo Ground in the Civil Lines area of the city of Allahabad. The existing piece of land which is the lungs of the city should be preserved as such. Consequently, a writ of mandamus is issued to the respondents, restraining them from making any construction on the Polo ground in question and to maintain it as an open piece of land. The respondents had dug up the land at a few places in the Polo Ground and the same was stopped on account of an interim order passed by this Court. Since we have restrained the respondents from making any constructions, we further direct the respondents to restore the land to its original shape within three months from today. The writ petition stands allowed with the directions as given above. In the circumstances of the case, there shall be no order as to cost. Dated : April 12,2005 AKJ”

However before the general public could reap the benefit of the green judgment of the High Court, the Union of India filed an SLP in the Supreme Court of India , vide SLP No. 14959 of 2005, later on converted to Appeal Civil No.5866 of 2006. There is a stay by the Supreme Court for last four years and as such a very important Question of Law remains undecided by the Supreme Court, the matter has not been listed after 15-12-2006 and that too after the three judges bench on 15-12-2006 itself said “Hearing of the appeal is expedited.”
3. Therefore the benefit given to the general public (having similar grievance in other towns and Cities of India), by the Allahabad High Court has been denied to the public by the arbitrary and Authoritarian stay order of the Supreme court for the last about four years and this may continue for generations. Therefore the Supreme Court, where it stays any order of the lower Courts, must ensure that the case is decided on merits within at the most six months and even if the party obtaining the stay abstains, or the Appeal is dismissed, only on technical grounds, the Case must be decided on merit and the question of law raised decided once and for all, so that future Confusion (in cases of other States, which may raise the issue again in case of any similar Judgment passed by their High Courts) is avoided.
